12-05.010 - Application of State law.

The provisions of this Chapter are intended to supplement the provisions of the Public Contracts Code of the State, or other applicable State laws pertaining to the award of contracts by the City. In the event of any conflict between the provisions of this Chapter and any applicable State law, the State law shall supersede and control the conflicting provisions contained herein.

12-05.020 - Criteria for selection.

In addition to price, in determining the lowest responsible bidder, consideration will be given to quality and performance of the services to be rendered or the materials, equipment or other supplies to be purchased. Criteria for determining low bid shall include, but not be limited to, the following:

(a) The ability, capacity and skill of the bidder to perform the contract or provide the supplies or services required.

(b) The ability of the bidder to provide the supplies or services promptly or within the time specified, without delay or interference.

(c) The character, integrity, reputation, judgment, experience and efficiency of the bidder.

(d) The quality of the bidder's performance on previous purchases or contracts with the City.

(e) The ability of the bidder to provide future maintenance, repair parts and services for the use of the equipment purchased.
