Sec. 3-19. - Mosaic tested seed/seedlings; "tested" defined, "designated area" defined.¶
(a) It is unlawful for any person, firm or corporation to plant any lettuce seed/seedlings (Lactuca sp.) in designated areas of Santa Barbara County which has not been mosaic tested.
(b) Mosaic tested seed/seedlings shall mean lettuce seed or seedlings grown from seed which has been tested at a testing facility approved by the county agricultural commissioner and which has been found to have 0.0 mosaic in thirty thousand seeds tested.
(c) The following are designated areas which constitute the major commercial lettuce growing areas that would be adversely affected by the introduction of infected seeds.
Santa Maria District Beginning at the end (west end) of West Main Street, Township 10N, Range 36W, proceed in a northerly direction to the San Luis Obispo County line. Proceed in an easterly direction along the county line to Fulgar Point and the Sisquoc River. Proceed in a southerly direction along the southern bank of the Sisquoc River to its intersection with the east/west line of the north boundary of Section I, Township 9N, Range 33W. Proceed east along the east/west line of the north boundary of Section I, Township 9N, Range 33W to the north/south common line separating Sections 31 and 32 of Township 10N, Range 31W. Proceed south on the north/south common line separating Sections 31 and 32 of Township 10N, Range 31W to its intersection with the southern border of Rancho Sisquoc. Proceed in a northwesterly direction along the southern border of Rancho Sisquoc to the intersection of Rancho Sisquoc southern border and Foxen Canyon Road. Proceed in a northerly direction on Foxen Canyon Road to the intersection of Foxen Canyon Road and the east/west line of the south boundary of Section 16 of Township 9N, Range 32W. Proceed west on this east/west line to its intersection with Casmalia Road, Township 9N, Range 35W. Proceed in a northerly direction on the Casmalia Road to the intersection of Casmalia Road and the Southern Pacific Railway Line. Proceed northwesterly along the Southern Pacific Railway Line to the intersection of the Southern Pacific Railway Line and Highway 1, bridge number 51-102, mile marker 46.48. Proceed in a northerly direction along Highway 1 to a point ¼ mile south of the intersection of Highway 1 and Brown Road. Proceed in a westerly direction along Brown Road approximately 1 mile then proceed in a northerly direction to Solomon Creek. Proceed in a northwesterly direction along Solomon Creek to a point south of the end of West Main Street. Proceed in a northerly direction to the beginning point.
Lompoc District All that portion of the Lompoc district described as follows: Parcel I Beginning at the intersection of Renwyck Avenue and the Santa Ynez River, located in Section 22 of Township 7N, Range 35W, proceed in an easterly direction along the Santa Ynez River to the north end of "L" Street, proceed south on "L" Street to Central Avenue then west on Central Avenue to "V" Street. Proceed south on "V" Street approximately 2.5 miles to the base of the Santa Ynez mountains. Proceed in a westerly direction along the base of the Santa Ynez mountains to Union Sugar Avenue, then north on Union Sugar Avenue to Central Avenue. Proceed west on Central Avenue to Renwyck Avenue then north on Renwyck Avenue to the Santa Ynez, beginning point.
Parcel II Beginning at "H" Street and the Santa Ynez River, proceed in an easterly direction along the Santa Ynez River to McLauglin Road. Proceed in an easterly direction on McLauglin Road to the intersection of Rucker Road and McLauglin Road, then proceed in a northerly direction on Rucker Road to the intersection of Rucker Road and the Lompoc/Casmalia Road, also known as Pukisima Road and Camp Cooke Access Road. Proceed in an easterly direction on Lompoc/Casmalia Road also known as Pukisima Road and Camp Cooke Access Road to the intersection of Lompoc/Casmalia also known as Pukisima Road and Camp Cooke Access Road and Highway 246, then proceed in a southerly direction approximately ¼ mile to the base of the Santa Rita Hills. Proceed in a southwesterly direction along the base of the Santa Rita Hills to Highway 246, then proceed in a westerly direction to the intersection of Highway 246 and the Santa Ynez River. Proceed in a northerly direction on the east side of the Santa Ynez River approximately 1 mile to Central Avenue. Proceed west on Central Avenue to "H" Street, then proceed north on "H" Street to the Santa Ynez River.
Parcel III Beginning at the intersection of Santa Rosa Road and Highway 1, mile marker SRA 0.00. Proceed in an easterly direction on Santa Rosa Road to mile marker 8.00. Proceed in an extended northerly line from mile marker 8.00 to the southern boundary line of Section 1, of Township 6N, Range 33W. Proceed in a westerly direction along the southern border of Sections 1, 2, 3, 4 and 5 of Township 6N, Range 33W to the north/south line of the west boundary of Section 5, Township 6N, Range 33W. Proceed south on the north/south line of the west boundary of Section 5, Township 6N, Range 33W to the Santa Ynez River. Proceed in a westerly direction along the Santa Ynez River to Highway 246. Proceed in a westerly direction on Highway 246 to the intersection of Highway 246 and Highway 1, then proceed in a southerly direction on Highway 1 to the intersection of Santa Rosa Road and Highway 1.

Sec. 3-20. - Application for exemption.¶
Notwithstanding the foregoing, any person, firm or corporation desiring to plant lettuce seed other than that which has been mosaic tested may apply to the agricultural commissioner of the county for a permit to plant such seed. The permit application shall be in writing and shall be in such form and give such details as the agricultural commissioner may require. If the agricultural commissioner, after investigation, finds that mosaic tested lettuce seed is not obtainable, or that good reason exists and further determines that such exemption will not jeopardize other lettuce producers, he may issue a permit authorizing the applicant to plant lettuce seed/seedlings which is not mosaic tested. In making his investigation, the agricultural commissioner may call upon growers and other qualified persons for their advice and counsel.

Sec. 3-21. - Exemption of seed for home use.¶
This article shall not prohibit any person from planting lettuce seed which has not been mosaic tested for such person's own home use.

Sec. 3-22. - Violations—Penalty.¶
Any violation of the provisions of this article constitutes a misdemeanor punishable by a fine of not more than five hundred dollars or by imprisonment in the county jail for a period not exceeding six months, or by both such fine and imprisonment. In addition thereto, any person who violates any provision of this article is liable in a civil action for all damages that may be occasioned or caused by violation of this article.
