9.20.010 - Definitions.

A. "Person" means any individual, firm, partnership, corporation or business association. The singular includes the plural.

B. Waste.

  1. "Domestic waste" means waterborne waste of the type resulting from flushing and washing waste products from residences and lavatories.

  2. "Industrial waste" means any waterborne waste from manufacturing, processing or industry, except domestic waste and uncontaminated cooling water.

  3. "Sewage" means any combination of domestic waste and industrial waste together with ground, surface and storm waters as may be present or any waste substances or materials collected or obtained from chemical or portable toilets or septic tanks, cesspools or other means of sewage disposal.

C. "Water pollution control system" means all facilities of the city of San Rafael for transporting sewage and/or storm drainage systems.

D. "Shall" is mandatory; "may" is permissive.

E. "Nuisance" means any nuisance known as common law or in equity jurisprudence.

9.20.020 - Dumping of waste prohibited.

No person shall dump or discharge any waste material into the water pollution control system of the city except through authorized connections issued by the San Rafael Sanitation District.

9.20.030 - Violations.

Any person violating the provisions of this chapter is guilty of a misdemeanor and guilty of a separate offense for each and every day during which said violation shall continue and upon conviction for each such violation shall be punishable to the provisions of Section 1.12.010 of this code.

Further, any violations of this chapter are deemed to be a nuisance per se and subject to abatement pursuant to the laws of the state of California and shall become liable to the city for any expenses, loss or damage occasioned by reason of such violation.
