8.12.020 Administration. ¶
A. The city manager, acting in his or her capacity as director of emergency services, shall be the head of the San José Police Reserve.
B. The city manager shall have the full power to supervise and control the activities of the reserve, and to designate, in writing, city officials and employees who shall be authorized to appoint and remove all personnel of the reserve, and to assist the city manager in the administration of the reserve.

8.12.030 Membership standards and qualifications. ¶
The city manager shall establish the standards and qualifications, in addition to those required by state law, required for membership in the San José Police Reserve.

8.12.040 Rules and regulations. ¶
Members of the San José Police Reserve shall be subject to all laws, policies, procedures, rules and regulations affecting officers of the San José Police Department, except those clearly inapplicable, and to such additional policy, procedures, rules and regulations as may be promulgated by the city manager.

8.12.080 Police functions.
8.12.090 Interference with members prohibited.
8.12.100 Impersonating police reserve members prohibited.
8.12.010 Establishment. ¶
A. There is an organization of volunteer civil defense workers which shall be known as the "San José Police Reserve."
B. The San José Police Reserve shall constitute and operate as a police division of the San José civil defense and disaster organization.

8.12.050 Compensation. ¶
A. Members of the San José Police Reserve shall serve without compensation with the exception of receiving uniform points, and shall not, for any purpose, be deemed officers or employees of the city.
B. Members of the San José Police Reserve are eligible to work outside compensated assignments after completing their probationary period and when permission is obtained.

8.12.060 Benefits. ¶
Members of the San José Police Reserve, while serving in such capacity, shall be entitled to those

worker's compensation benefits provided by the California Disaster Act and the Worker's Compensation laws of the state, as well as all other benefits, privileges and immunities provided in federal, state and local laws for their benefit and protection. (Ord. 25213.)
8.12.070 Functions and duties generally. ¶
Members of the San José Police Reserve shall perform such duties and engage in such activities as required by this chapter, the rules and regulations of the organization, or as directed by the city manager, including, but not limited to, preparing against perils in civilian life and property that may be expected as a result of enemy attack or sabotage or natural disasters, and working closely with the police department of the city in the enforcement of penal laws, as part of a training program to better qualify members in coping with problems of civil defense, disaster and other public service activities. 8.12.080 Police functions. ¶
Members of the San José Police Reserve are assigned those specific police functions set forth in this chapter, and such additional functions as may be assigned by the city manager. (Ord. 25213.)
8.12.090 Interference with members prohibited. ¶
It shall be unlawful for any person to willfully resist, delay or obstruct any member of the San José Police Reserve in the discharge of any duties of his or her office.

8.12.100 Impersonating police reserve members prohibited. ¶
No person shall falsely impersonate or represent him or herself to be a member of the San José Police Reserve, or wear or use or possess any badge, star or uniform or other indicia of membership unless authorized to do so. (Ord. 25213.)
