SANITARY SEWER EXTENSION PROGRAM

Sections:

• A. A sanitary sewer extension program is hereby established. Said program shall consist of a special financing plan to assist property owners in the "sanitary sewer extension program area" with repayment of funds advanced by the city for certain capital improvements and to provide incentives for these property owners to connect to the city sewer system by allowing for installment payments of program costs and sewer treatment plant connection fees.

• B. Participation in said program shall be voluntary. However, nothing in this chapter shall affect any existing provision of law requiring connection to the city sewer system.

• C. The director of the department of public works shall administer and implement the program.

The provisions of this chapter apply only to the owners of those parcels which constitute the "sanitary sewer extension program area." Said parcels are those designated on a map adopted by resolution of the city council and kept on file in the office of the city clerk. The terms and conditions of the program shall be set forth in said resolution. (Ord. 23023.)

• A. Installment payments to be made by program participants shall be placed on the Santa Clara county property tax roll. The city shall request the Santa Clara county tax collector to collect the installment payments on behalf of the city.

The outstanding obligation shall be recorded as a lien against the parcel to be connected to the city sewer system pursuant to this program.

• B. In the event a participant conveys, exchanges, or transfers all or any part of the liened property, whether voluntarily or by operation of law, the full amount of the unpaid balance and any accrued interest shall be immediately due and payable.

• A. Sanitary sewer connection fees for those property owners in the program who elect to participate prior to the deadline designated by the director of public works, as specified in Resolution No. 61109, approved by the city council on January 10, 1989, shall be charged at the rates in effect for fiscal year 1987-1988 as set by Ordinance No. 22545, adopted by the city council on June 9, 1987.

• B. Eligible property owners who elect to connect to the sewer system after the designated deadline shall pay sewer connection fees at the rate in effect at the time that connection fees are paid.
