§ 6.44.010. Consuming alcoholic beverages on public streets, etc., or on private…¶
A. No person shall consume any alcoholic beverage in any quantity or have in his or her possession or on his or her person any bottle, can or other receptacle containing an alcoholic beverage which has been opened, or a seal broken or the contents partially removed, while such person is standing, sitting or otherwise occupying any public street, avenue, sidewalk, stairway, alley, thoroughfare, public parking lot, or private parking lot open to the public within the city of San Bruno; nor shall any person consume or possess, as described above any alcoholic beverage within fifteen feet of any public street, avenue, sidewalk, stairway, alley, thoroughfare, public parking lot, or private parking lot open to the public while on a private stairway, doorway, or other private property open to public view without the express or implied permission of the owner, owner's agent, or the person in lawful possession thereof.
B. This section shall not apply: to the interior portion of any private dwelling, habitat or building; to the consumption or possession by persons in the areas herein designated of any duly prescribed and dispensed medication having alcoholic content; to those persons consuming or possessing alcoholic beverages while viewing a parade or similar event for which a permit has been properly granted and consumption of alcoholic beverages specifically authorized pursuant to city of San Bruno ordinance or regulation; or to an encroachment or similar permit issued by the city of San Bruno wherein consumption of alcoholic beverages on public property is specifically authorized.
C. Furthermore, this section shall not be applicable in those areas and during such time as the city has granted permission for temporary use or occupancy of public streets and appurtenant areas pursuant to the ordinances and regulations of the city of San Bruno.
