§ 4.56.010. Distribution regulations.

No person shall distribute, deliver, place, post, leave, or fix or cause to be distributed, delivered, placed, posted, left or fixed to any public or private property any written material except in the following manner:

A. By handing the same personally to any person or the owner or occupant of any property or premises; or

B. By placing or depositing the written material upon or fixing the same to the porch, vestibule, or door sill of the house or building occupying such property or premises in such a manner that the written material will not be exposed to the elements nor be blown about from such premises or drift about such premises, sidewalks, streets or other public places.

C. Notwithstanding the foregoing, it is illegal for any person to deliver, throw, deposit, or procure another to throw or deposit, written materials on public or private property by attaching such written materials to a stone or stones or other heavy object or objects or similar materials or within a bag containing a stone or stones or other heavy object or objects or similar materials.

D. Distribution of written materials in a manner that violates this section constitutes a public nuisance.

E. Anyone who violates this section is guilty of a misdemeanor and shall be punished in accordance with Chapter 1.28 of the city code.

F. In addition to any criminal enforcement, the city may pursue any other remedies available at law.
