§ 4.24.010. Designation of facilities.

The city council may by resolution find and declare that there are privately owned and maintained off-street parking facilities, as described in such resolution, within the city that are generally held open for use of the public for purposes of vehicular parking.

§ 4.24.020. Application of certain provisions of Vehicle Code.

A. Upon enactment of such resolution, Section 22507.8 of the Vehicle Code (pertaining to prohibition of parking of vehicles in stalls designated for the physically disabled) shall apply to such facilities, except as provided in subsection C.

B. In addition, if specifically stated in such resolution, Section 22350 (basic speed law for non-commercial vehicles), Section 23103 (reckless driving), Section 23109 (speed contests and exhibitions of speed), and the provisions of Division 16.5 (off-highway vehicles) of the Vehicle Code shall apply to such facilities, except as provided in subsection C.

C. No resolution enacted pursuant to this chapter shall apply to any off-street parking facility described therein unless the owner or operator has cause to be posted in a conspicuous place at each entrance to such off-street parking facility a notice not less than seventeen by twenty-two inches in size with lettering not less than one inch in height, to the effect that such off-street parking facility is subject to public traffic regulations and control.

D. Prior to the enactment of any such resolution the city council shall conduct a public hearing thereon with not less than ten days prior written notice to the owner and operator of the privately owned and maintained off-street parking facility involved.
