7-7.01 - Duty to safeguard equipment.

Whenever any work is authorized by the Council to be done upon, in, over or under any of the public streets, roads or highways of the City, it shall be the duty of the person owning or having under his control pipes, wires, telegraph, telephone or electric light poles, tracks, conduits or property upon, in, over or under such public streets, roads or highways of the City to protect and safeguard said pipes, wires, telegraph, telephone or electric light poles, tracks, conduits or property upon, in, over or under said public streets, roads or highways, according to the necessities thereof.

7-7.02 - Notice of proposed work.

Whenever any work is authorized by the Council to be done upon, in, over or under any of the public streets, roads or highways of the City, the contractor or the City Clerk may notify, in writing, any person owning or having under his control pipes, wires, telegraph, telephone or electric light poles, tracks, conduits or property upon, in, over or under such public streets, roads or highways of the City to remove or adjust as much of his wires, telegraph, telephone or electric light poles, tracks, conduits or property as will allow the prosecution of the work.

Said notice shall be accompanied by a copy of the plans and specifications for the work, showing the location of the said work in the streets, roads and highways, and describing the same. The notice shall specify a reasonable time within which said pipes, wires, telegraph, telephone or electric light poles, tracks, conduits or property must be removed or adjusted.

7-7.03 - Duty of owner to protect equipment.

Any person having pipes, wires, telegraph, telephone or electric light poles, tracks, conduits or property upon, in, over or under such public streets, roads or highways upon, in, over or under which said work is authorized to be done shall, upon receipt of the notice, protect and safeguard such pipes, wires, telegraph, telephone or electric light poles, tracks, conduits or property or remove, adjust or cause to be protected and safeguarded or removed or adjusted within the time specified in the notice so much of the pipes, wires, telegraph, telephone or electric light poles, tracks, conduits or property belonging to or under the control of such person as is liable to damage or as will allow the said work to be prosecuted according to the plans and specifications therefor.

7-7.04 - Duty of City Engineer to protect equipment.

If any person fails, neglects or refuses to remove or adjust, or cause to be removed or adjusted within the time specified in said notice said pipes, wires, telegraph, telephone or electric light poles, tracks, conduits or property, the City Engineer shall remove or adjust, or cause to be removed or adjusted, so much of the pipes, wires, telegraph, telephone or electric light poles, tracks, conduits or property specified in said notice as may be requisite for the prosecution of the authorized work according to the plans and specifications therefor. The necessary expenses incurred in such removal or adjustment shall be charged to the person failing, neglecting or refusing to comply with the requirements of the notice and may be recovered in an action at law brought in the name of the City against such person.
