5.104.010 "Producer" defined.

For the purposes of this chapter, producers shall mean persons who raise their own products on land owned or leased by themselves. In the sale of such products, producers may sell by agent; provided, that satisfactory evidence must be furnished by such agent as to his or her authority to act for his or her principal. Such authorization shall be for a limited period of time only, not exceeding ninety (90) days, and for reasons which must be passed upon by the city manager as good and sufficient. 5.104.020 Created-Location.

There is created and established in the city a producers' market which shall be located on a site to be selected by the city manager with the approval of the city council. Such site or location may be changed from time to time as public convenience and public policy shall require. Such market shall be open for the purpose of displaying and selling produce raised within a radius of twenty-five (25) miles from the city; provided, however, that the whole of Sacramento County shall be included. 5.104.030 Sale, etc., of certain items prohibited.

It is unlawful for any person to display, offer for sale or sell in the producers' market any produce purchased directly or indirectly from any other person or forestalled in any manner or at any place. It is likewise unlawful for any producer, by himself or herself or his or her agent, to offer for sale in such market any product not produced upon land either owned or leased by himself or to sell or offer for sale any manufactured or prepared article unless the main ingredient thereof has been produced upon lands owned or leased by the producer offering for sale or selling such article.

It is also unlawful for any person by himself or herself or his or her agent to display, offer for sale or sell in such market any product displayed, offered for sale or sold by such person, by himself or herself or his or her agent, in or upon any established wholesale market; provided, however, that this prohibition shall be applied to and its application determined within each crop selling season of such product separately. 5.104.040 Misrepresentations, etc., of articles prohibited.

It is unlawful for any person to use any deception or misrepresentation in selling or attempting to sell any article in the producers' market. (Prior code § 31.01.004)

5.104.050 Permit required.

No person may utilize the producers' market for the purpose of exhibiting or selling produce without receiving a permit to do so from the health officer. To receive such permit, the applicant shall submit a sworn statement to the health officer showing that he or she is entitled to the privilege of the market as provided in this chapter. 5.104.060 Daily fee.

A daily fee established by resolution of the city council shall be charged each producer making use of the producers' market which shall be used, in whole or in part, to defray the costs of the inspection, improvement and betterment of such market. (Prior code § 31.01.006)

5.104.070 Rules and regulations.

The health officer shall have power to make rules and regulations not inconsistent with the laws of the state and subject to the approval of the city manager covering the conduct and control of the producers' market and producers making use thereof. (Prior code § 31.01.007)

5.104.080 Selling from vehicle, etc., outside market prohibited.

It is unlawful for the operator of any vehicle, pushcart or other device, whether moved by human power or otherwise, to park or stand the same upon any street adjacent to the site selected for the producers' market for the purpose of selling goods or merchandise therefrom. (Prior code § 31.01.009)

5.104.090 Violation-Penalty.

Any person who shall violate any of the provisions of this chapter or of the rules and regulations prescribed for the conduct and control of the producers' market and of the producers making use thereof shall be guilty of an infraction and may be suspended or excluded from the market by the health officer.
