12.40.010 Purpose.

The provisions of this chapter shall apply to and control the installation of gates, barriers or other control devices to restrict vehicular or pedestrian traffic through alleys as authorized by Section 21102.1 of the California Vehicle Code. This chapter shall not apply to or affect any closure or abandonment of a street or alley pursuant to any other provisions of state law or this code. (Prior code § 38.17.250)

12.40.020 Adoption of resolution-Findings required.

The city council may adopt a resolution authorizing the restriction of vehicular or pedestrian traffic through any alley or alleys pursuant to this chapter by means of gates, barriers, or other control devices, when the city council finds that such restriction is necessary for the protection or preservation of the public peace, safety, health, or welfare. 12.40.030 Duration of restriction.

Any restriction of vehicular or pedestrian traffic authorized pursuant to Section 12.40.020 of this chapter shall remain in effect for such period of time as specified in the city council's resolution authorizing such restriction, or if no time period is specified, until the city council finds that such restriction is no longer necessary for the protection or preservation of the public peace, safety, health, or welfare. 12.40.040 Permits required for improvements in public right-of-way.

If the restriction of vehicular or pedestrian traffic authorized pursuant to Section 12.40.020 of this chapter requires construction by a private entity of improvements such as fencing, gates, or lighting in the public right-of-way, a revocable encroachment permit and an excavation permit must be obtained from the public works department. The revocable encroachment permit must be issued simultaneously with the authorization of such restriction by the city council. The excavation permit, if required, may be issued subsequent to city council authorization of such restriction, but must be obtained prior to the construction of any improvements in the public right-of-way. The city manager, in his or her discretion, may waive the fees required for these permits. (Prior code § 38.17.253)

12.40.050 Signs required.

Prior to the installation of any gates, barriers, or other control devices restricting vehicular or pedestrian traffic in any alley, signs giving notice of such restrictions shall be posted at every entrance to the alley. (Prior code § 38.17.254)

12.40.060 Limitation.

Except as provided otherwise in this chapter, no gates, barriers or other control devices installed in any alley pursuant to this chapter shall be operated in a selective manner that restricts the access of some vehicles and/or pedestrians to the alley, while permitting other vehicles and/or pedestrians unrestricted access to the alley. (Prior code § 38.17.255)

12.40.070 Access for utilities, freight, emergency and municipal services.

Any gates, barriers, or other control devices installed to restrict vehicular or pedestrian traffic through any alley, when authorized by the city council pursuant to Section 12.40.020 of this chapter, shall be installed and/or operated in such manner that adequate access is maintained:

A. For the maintenance, operation, replacement, removal, or renewal of utility facilities existing in or accessible through the alley; and

B. For the delivery of freight by commercial vehicles; and

C. For the operation of emergency vehicles; and

D. For the performance of municipal services. (Prior code § 38.17.256)

12.40.080 Procedures.

The city manager, or his or her designee, may adopt procedures for the implementation of the provisions of this chapter, including procedures for reviewing requests to restrict vehicular or pedestrian traffic in an alley pursuant to this chapter. (Prior code § 38.17.257)
