13.04.010 - Permit required when.

It is unlawful for any person, firm or corporation to construct or maintain any dam or obstruction that may interfere with or obstruct the natural flow of water in any natural watercourse or natural drainage course within the City without first securing from the City Council a permit authorizing the construction or maintenance of said dam or obstruction.

13.04.020 - Nuisance abatement—Authorized when.

Any obstruction or dam constructed or maintained in violation of this chapter shall constitute a public nuisance, and if any such dam or obstruction is not removed within thirty days after an order of court of competent jurisdiction requiring the removal of said dam or obstruction, said dam or obstruction may be summarily removed and abated by the City.

13.04.030 - Nuisance abatement—Cost assessment.

All costs of court and attorneys fees, as fixed by the court, and costs of removing any such dam or obstruction, shall be assessed against the person, firm or corporation constructing and/or maintaining said dam or obstruction.

13.04.040 - Violation—Penalty.

Any person or corporation violating any provisions of this chapter, upon conviction thereof, shall be punishable by a fine not to exceed five hundred dollars or by imprisonment in the County jail for a period not to exceed six months, or by both such fine and imprisonment.
