9.04.010 - Intoxication in private—Annoyance of others prohibited.

No person shall be in any private house or on any private premises in the city in a state of drunkenness or intoxication to the annoyance of any other person.

9.04.020 - Gambling prohibited—Exception.

It shall be unlawful for any person to deal, play, carry on, open or conduct any game of chance played with cards, dice, or any other device, for money, checks, credit or thing of value; and no person shall bet at any of the prohibited games. There shall be excepted from the effect of this section, but not from the effects of Penal Code Section 330 or any other state proscription, occasional private games played exclusively for social purposes in a private home, provided such games are not conducted with any aspect or manifestation of commercialism, and with respect to which there is no promoter, house charge, advertising, promotion or participation by members of the public.

9.04.030 - Guns—Discharging restrictions.

No person shall shoot, fire or discharge any pistol, rifle, gun or other firearm or any pistol, rifle or gun operated by compressed air, or a spring device including, but not limited to, B.B. or pellet guns, not necessary in self-defense, or in performance of an official duty within the city.

9.04.040 - Fireworks—Exploding/Possession prohibited.

No person within the city shall explode or have in his possession any fireworks, as that word is defined in the state fireworks law.

9.04.050 - Parties in residential zones—Charging admission prohibited.

A. As used herein:

  1. "Charge admission" means the demand and receipt of a tangible benefit, monetary or otherwise, which is a motivating influence for admission to the party. The customary courtesies and clearly noncommercial activities such as gifts by guests, sharing of expenses for dinner and beverages, or reciprocal hospitality, shall not be considered to be a charge for admission. A charge for admission does not include a donation for a political, charitable or religious purpose.

  2. "Party" means a group of persons meeting together for social, recreational or amusement purposes.

B. It is unlawful to charge admission to any party conducted in a residential area.

9.04.060 - Wild birds—Protection.

No person shall shoot, trap, take or injure, in any fashion or by any means, any wild bird, bird nest or wild bird egg within the city. This section shall not apply to:

A. Any person who has purchased or otherwise legally acquired a wild bird with respect to such wild bird;

B. Any peace officer or other public officer duly engaged in enforcement of federal, state or city law; or

C. Any person who has first obtained a permit from the city for the humane trapping and relocation of peafowl pursuant to procedures adopted by resolution of the city council. Only peafowl shall be subject to such procedures.

9.04.070 - Public property—Injuring prohibited.

No person shall injure, destroy, or remove any ornament, improvement, building or structure in any public park or street of the city.
