12.08.010 - Prohibitions designated.

A. No person shall throw or deposit upon any city street any glass bottle, glass, nails, tacks, hoops, wire, cans or any other substance likely to injure any person, animal or vehicle upon the highway.

B. It is unlawful to place, deposit or dump, or cause to be placed, deposited or dumped, any garbage, swill, cans, bottles, papers, ashes, refuse, carcass of any dead animal, offal, trash, or rubbish or any noisome, nauseous or offensive matter in or upon any city street including any portion of the right-of-way thereof.

C. It is unlawful to place, deposit or dump, or cause to be placed, deposited or dumped, any rocks or dirt in or upon any city street, including any portion of the right-of-way thereof, without consent of the city public works director or city engineer.

12.08.020 - Removal of material.

Any person who drops or permits to be dropped or thrown upon any city street any destructive or injurious material shall immediately remove the same or cause the same to be removed. Such person shall reimburse the city for any costs incurred in removing said materials from city streets.

12.08.030 - Spilling vehicle loads.

No vehicle shall be driven or moved on any city street unless the vehicle is so constructed or loaded as to prevent any of its contents or load other than clear water from dropping, sifting, leaking, or otherwise escaping therefrom.

12.08.040 - Plastic-type soil.

The city council finds and determines that plastic-type soil deposited upon city streets is inherently damaging to said streets. Any person or business or organization that has dropped or deposited plastic-type soil upon any city street, and fails to remove said soil from the street within twenty-four hours after written notice from the city or any officer thereof, shall pay to the city treble the amount of costs incurred by the city in removing said plastic-type soil or treble the amount of damage inflicted upon the street by said soil, whichever is the greater.

12.08.050 - Violation—Penalty.

Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this chapter shall be guilty of a misdemeanor unless by ordinance the violation is made an infraction. Except in cases where a different punishment is prescribed by any ordinance of the city, any person convicted of a misdemeanor under the ordinances of the city shall be punished by a fine of not more than five hundred dollars or by imprisonment not to exceed six months, or by both such fine and imprisonment. Every violation determined to be an infraction is punishable by: (A) a fine not exceeding fifty dollars for a first violation; (B) a fine not exceeding one hundred dollars for a second violation of the same ordinance within one year; (C) a fine not exceeding two hundred fifty dollars for each additional violation of the same ordinance within one year.

Each such person is guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the city is committed, continued or permitted by any such person, and he shall be punished accordingly.
