17.64.010 - Special uses—Designated.

Special uses are as follows:

A. Airport and landing fields;

B. Cemeteries;

C. Establishment of enterprises involving large assemblies of people or automobiles on a permanent basis, including:

  1. Amusement parks and race tracks;

  2. Recreational facilities privately operated;

D. Hospitals, sanitariums;

E. Institutions of charitable nature;

F. Removal or deposit of earth other than in connection with construction of buildings, roadways, or home or public improvements on the site.

17.64.020 - Special uses—Use permit—Criteria.

A. All of the uses listed in Section 17.64.010 and all matters directly related thereto, are declared to be uses possessing characteristics of such unique and special form as to make impractical their inclusion in any class of use set forth in the zones defined in this title. Therefore, the authority for the location or the operation of any of the uses designated in this chapter shall be subject to the issuance of a use permit in accordance with the provisions of Chapter 17.70.

B. In addition to the criteria set forth in Chapter 17.70 for determining whether or not a conditional use permit should be issued, the hearing body shall consider the following additional factors in determining whether the uses listed in this chapter will be incompatible with other uses permitted in the zone and surrounding areas. Such factors are:

  1. Damage or nuisance from noise, smoke, odor, dust, vibrations or water pollution;

  2. Hazard from explosion, contamination or fire;

  3. Hazard occasioned by unusual volume or character of traffic, or the congregating of a large number of people or vehicles.

17.64.030 - Prohibited uses.

The following uses are prohibited in all zones, and no conditional use permit shall be issued therefor:

A. Kennels for purposes of breeding and raising animals for sale;

B. Junkyard;

C. Refuse disposal site.

17.64.060 - Single room occupancy (SRO) facilities.

A. Subject to the approval of a conditional use permit single room occupancy (SRO) facilities may be permitted in the following zone districts:

  1. Commercial Highway (C-H).

  2. Retail Business Commercial (C-2).

  3. General Service Commercial (C-3).

  4. General Retail Service Commercial (C-4).

  5. Planned development districts: Subject to the approval of a conditional use permit SRO facilities may be permitted in any planned development (PD) district that would also allow hotels or motels.

B. Criteria in General. The following are the minimum criteria applicable to all new single room occupancy (SRO) facilities:

  1. All SRO facilities are subject to approval of conditional use permit and design review entitlements.

  2. Occupancy.

(a) SRO rooms shall be occupied by no more than two persons.

(b) SRO rooms shall be occupied as the primary residence of the tenant. Transient occupancy of SRO rooms shall not be allowed. For purposes of this section "transient" shall be as defined in RMC Section 5.24.020.

  1. Proximity to transit and alternative transportation modality shall be considered and encouraged in the siting of all SRO facilities.

  2. Unit Size. SRO rooms shall be a minimum of one hundred fifty square feet in area and a maximum of four hundred square feet in area.

  3. Facilities.

(a) Kitchen. No kitchen facilities are required to be provided. Full or partial individual kitchen facilities may be provide for each room, or one common (shared) kitchen/dining area may be provided if the developer/operator so desires.

(b) Bathrooms. Private bathroom facilities shall be provided within each unit to include, at a minimum, a toilet and wash basin. Bathtubs and/or shower facilities shall be provided but may be provided within individual rooms, or may be shared.

(c) Laundry Facilities. A common laundry area shall be provided at a rate of not less than one washer and one dryer for the first ten rooms, with one additional washer and one additional dryer provided for every five additional rooms or fraction thereof.

(d) Accessibility. Any and all common facilities shall be provided as fully accessible, to the satisfaction of the building official.

  1. Manager's Office or Unit. An on-site management office or manager's unit shall be provided. "House rules" shall be submitted as a part of the use permit application.

  2. Parking. Parking for SRO facilities shall be provided one space for every two SRO rooms, plus one space for the management unit or office and one space for each employee, if any, on maximum shift.

  3. Storage for Residents. A private, secured storage space of not less than fifty cubic feet per resident shall be provided. Storage space may be provided in private closet(s) accessible from individual SRO rooms; and/or as individually locked areas accessible from a common room; and/or within a separate on-site storage structure. Where storage space is provided within a separate structure, such structure shall provide for separate, locking storage spaces for each SRO room, and shall be of sufficient construction to protect stored items from weather.

17.64.070 - Kennels.

A. Kennels, for boarding of animals for commercial or noncommercial purposes, except those prohibited by Section 17.64.030.A, are permitted in the following zone districts subject to issuance of a conditional use permit and compliance with the criteria set forth in Sections 17.64.070.B and C below:

  1. C-2: retail business zone;

  2. C-3: general and service commercial zone;

  3. C-4: limited general retail and service commercial zone;

  4. C-H: highway commercial zone;

  5. M-1: manufacturing zone;

  6. M-2: heavy industrial zone;

  7. Planned development zone districts equivalent to the above.

B. Application Submittal. Applications for a conditional use permit for a kennel shall include the items specified in Section 17.70.030, Application, and shall also include, but not be limited to the following:

  1. Design plans for any exterior modifications related to the outdoor dog enclosure, such as walls, fencing, lighting, hardscape, and plantings;

  2. A written statement of compatibility, including all relevant details of the proposed use, such as abutting business operations (if located in a multi-tenant building or adjacent to other surrounding uses), type of use, operating hours, number of employees, parking, traffic impacts, and other pertinent information; and

  3. When proposed within an existing multi-tenant building, the applicant shall provide a floor plan of their entire tenant space, as well as all adjacent tenant space; and

  4. If any component of the kennel is proposed to be outdoors, a noise study (prepared by a qualified noise professional) is required to demonstrate compliance with the noise standards of the General Plan Noise Element and Noise Standards Ordinance.

  5. In addition to the standard noticing requirements, any kennel application that includes an outdoor enclosure shall require an early notice to be mailed to surrounding properties. The early notice constitutes the final administrative action prior to the city's determination that an application submittal is complete. The notice shall be provided to all property owners of record and to mailing addresses within three hundred feet of the subject property, advising that an application has been received, providing a summary of the application, and the location where project documents can be reviewed. This notice shall be mailed no fewer than thirty days prior to the date of the planning commission hearing.

C. All kennels shall comply with the following criteria:

  1. The kennel use facility, premises, and surrounding area shall be regularly cleaned and maintenance shall be conducted in accordance with applicable health and sanitation standards.

  2. All animals housed in the facility shall be cared for in accordance with Chapter 11 (Pet Boarding Facilities) of the California Health and Safety Code (Sections 122380-122388).

  3. The building or tenant space in which the kennel is located shall be improved and maintained such that animals housed there do not cause regular annoyance and disturbance to persons in the surrounding area, including but not limited to noise, odor, waste disposal, etc. A medical-grade filtration system shall be installed to prevent the spread of noxious odors.

  4. The kennel use shall be conducted entirely within a building with no outside activities or storage, except:

(a) When a noise study is submitted and approved with the project application demonstrating compliance with applicable noise regulations;

(b) When the hours for any outdoor kennel operations are restricted to between the hours of 8:00 AM to 8:00 PM;

(c) When located more than two hundred feet from the boundary of any residentially zoned parcel;

(d) When located on parcels that directly abut a state highway, interstate highway, or arterial road, as designated in the general plan circulation element, and the noise from the roadway facilities is the predominant noise source at the kennel location; and

(e) When a sign is installed and maintained at the edge of the public right-of-way that clearly displays the name and telephone number of a designated business representative responsible for addressing noise or odor complaints.

  1. The operations of the kennel shall comply with all applicable regulations and requirements of county and state agencies. All health and safety permits shall be posted in a public location.
