Sec. 1-93. - Misdemeanor unless declared infraction.

A violation of this Code shall be a misdemeanor unless by ordinance it is made an infraction.

Sec. 1-94. - Misdemeanor violations.

Except as otherwise provided by law or ordinance, a violation of this Code that is a misdemeanor shall be punished by a fine of not more than $1,000.00, imprisonment in the city or county jail for not more than six months or both such fine and imprisonment.

Sec. 1-95. - Infraction violations.

(a) Except as otherwise provided by law or ordinance, a violation of this Code that is an infraction shall be punished by:

(1) A fine not exceeding $100.00 for a first violation.

(2) A fine not exceeding $200.00 for a second violation of the same provision within one year.

(3) A fine not exceeding $500.00 for each additional violation of the same provision within one year.

(b) Except as provided by law, a violation of this Code that is an infraction that is a violation of local building and safety codes shall be punished by:

(1) A fine not exceeding $100.00 for a first violation.

(2) A fine not exceeding $500.00 for a second violation of the same provision within one year.

(3) A fine not exceeding $1,000.00 for each additional violation of the same provision within one year.
