State Law reference— Documentary Transfer Tax Act, Revenue and Taxation Code § 11901 et seq.

(a) Under the authority contained in the Documentary Transfer Tax Act (Revenue and Taxation Code § 11901 et seq.), there is hereby imposed upon each deed, instrument or writing by which any lands, tenements, or other realties sold within the city shall be granted, assigned, transferred or otherwise conveyed (exclusive of the value of any lien or encumbrance remaining thereon at the time of sale) exceeds $100.00, a tax at the rate of $00.275 per each $500.00 or fraction thereof.

(b) Any real property transfer tax shall be paid by any person who makes, signs or issues any document or instrument subject to the tax or for whose use or benefits the same is made, signed or issued.

The real property transfer tax shall not apply to the transactions exempted by Revenue and Taxation Code div. 2, pt. 6.7, ch. 3 (Revenue and Taxation Code § 11921 et seq.).

(a) The county recorder shall administer the provisions of this article in accordance with the provisions of the Documentary Transfer Tax Act (Revenue and Taxation Code § 11901 et seq.) and the provisions of any county ordinance adopted pursuant thereto.

(b) Claims for the refund of the taxes imposed pursuant to this section shall be governed by the provisions of the Revenue and Taxation Code.
