3-5-1: PERMIT REQUIRED:

No person in any zone district in the city shall sell or advertise in any manner whatever a sale of new or used merchandise at a garage, yard, patio or similar sale without obtaining a special permit from the finance department and complying with the rules and regulations for same. 3-5-2: RESTRICTIONS:

No person shall sell or offer for sale personal property in any residential zone except personal property owned, utilized and maintained by such person or members of his family on or in connection with the premises which they occupy. Personal property offered for sale shall not be displayed in the front or side yards of any such premises; provided, however, that a vehicle offered for sale may be displayed on a permanently constructed driveway within such front or side yards. 3-5-3: GARAGE AND SIMILAR SALES:

In the event miscellaneous items of personal property are to be offered for sale to the general public by means of a garage sale, patio sale or other sale similarly conducted, the person conducting such sale shall file an affidavit with the finance department stating that all the property to be sold is his own personal property and has not been acquired or consigned to him for purposes of resale. 3-5-4: APPLICABILITY OF PROVISIONS:

The provisions of this chapter shall apply to all such sales whether conducted by the owner, tenants, their agents, consignees or otherwise and/or by profit and nonprofit organizations.

A. The license fee for sales covered by this section may be established and modified from time to time by resolution of the city council. (Ord. 95-009, 6-13-1995)

B. The maximum period of sale shall be three (3) days.

C. The maximum number of such sales at said address shall be limited to two (2) per year while the land is vested in the same ownership.

D. The finance and police departments shall enforce the provisions of this section and may establish other necessary rules and regulations pertaining to the sale affecting the public health and safety, and providing a reasonable area for public travel.

E. The police department shall have the right to order the withdrawal from sale of any items which do not comply with this section. (Ord. 560, 6-1-1976)

3-5-5: SIGN RESTRICTIONS:

No signs shall be posted in any place other than the property where the sale is being conducted. Said signs shall not exceed six (6) square feet in size. (Ord. 560, 6-1-1976)

3-5-6: EXCEPTIONS:

A. Sections 3-5-1 through 3-5-5 of this chapter shall not apply to sales of personal property made under court order or process.

B. In the case of churches, public schools, fraternal organizations and other nonprofit entities, sales for charitable purposes may be conducted in residential zones upon approval of the city manager.

C. In the case of persons who otherwise qualify under the provisions of this chapter, a sale conducted by a group of such persons, either within a gated community, within a mobile home park, or within a neighborhood, may be permitted for a period not to exceed three (3) consecutive days, upon the payment by the group of a license fee in the amount established by the city's annual fee resolution. 3-5-7: SIDEWALK AND OPEN SPACE SALES:

No person in the city shall sell or advertise in any manner whatsoever a sale of any goods or merchandise at sidewalk or open space sales, auctions or conduct a promotion for fundraising by nonprofit organizations without obtaining a special permit from the finance department. A permit will be required for each sale, five (5) days or more before sale.

A. Subsections 3-5-4D and E of this chapter shall apply to open space sales.

B. No more than four (4) sidewalk sales per calendar year shall be permitted.

C. For sales and fundraising promotions, and auctions by nonprofit organizations lasting in excess of three (3) days, the applicant shall first apply and obtain a special use permit from the planning commission in accordance with this code.

D. In all cases, the permittee will furnish to the city a certificate of insurance regarding public liability in an amount satisfactory to the city manager. The city manager, or designee, may allow recognized merchants or other groups to provide group insurance coverage for the benefit of the designated members.

E. For all sidewalk sales, auctions, fundraising promotions for the nonprofit organization of three (3) days or less in duration in any zone, the city manager, or designee, is authorized upon a proper showing, to approve said application.

F. No nonprofit organization shall conduct, promote or sponsor more than two (2) car washes per year within the city and no such car wash shall exceed two (2) days in length. The restrictions of this subsection shall not apply to car washes carried out on property owned by the sponsoring nonprofit organization. (Ord. 96-006, 4-9-1996)

3-5-8: CARNIVALS, FIESTAS, CIRCUSES, BAZAARS, PARADES AND SIMILAR PUBLIC SHOWS:

A. Every person engaged in the business of exhibiting, conducting, managing or operating a carnival, fiesta, circus, bazaar, parade or other similar public show shall pay a special event permit application fee in an amount set by resolution of the city council and shall comply with the following:

  1. Such events shall be sponsored and conducted only by nonprofit organizations located in the city and primarily serving the Reedley community.

  2. Each sponsoring organization shall be permitted a maximum of four (4) such events during any calendar year.

  3. Organizations sponsoring such events shall pay all direct costs of municipal services including, but not limited to, policing, garbage disposal and traffic enforcement within thirty (30) days following the completion of the event.

  4. No sponsoring organization shall advertise, conduct or operate such an event without first having obtained a special event permit issued by the city manager, or his designee, pursuant to subsection D of this section; and, for any such event to be located in a city park, the sponsoring organization must also apply for and first obtain permission from the recreation and park commission.

  5. Such events shall have maximum operating duration of three (3) consecutive days.

  6. A maximum of two (2) such events per calendar year may occur on any privately owned parcel(s) of land in the city.

B. Every person engaged in the business of exhibiting, conducting, managing or operating a privately owned business at a carnival, fiesta, circus, bazaar, parade or similar public show, shall pay a license fee set by resolution of the city council.

C. Special event permits may be obtained from the city upon written application filed with the city. The application shall require at least the following information:

  1. The name and address of the nonprofit organization engaged in the business of sponsoring, managing, carrying on and directing such carnival, fiesta, circus, bazaar, parade or similar public show;

  2. Copy of city nonprofit business license;

  3. The place where such carnival, fiesta, circus, bazaar, parade or similar public show is to be exhibited and the proposed site layout, including site dimensions, fencing and access points;

  4. The type or manner of such carnival, fiesta, circus, bazaar, parade or similar public show;

    1. The time and date of arrival (setup) and departure (takedown);
    1. The time, date and number of performances to be exhibited;
    1. Hours of operation open to the public.

D. Upon receipt of application, the city manager, or his designee, shall investigate the business of the applicant, the appropriateness of the location and the type of carnival, fiesta, circus, bazaar, parade or similar public show proposed to be produced. Thereupon the city manager, or his designee, may approve the application and authorize the issuance of a special event permit thereon, or the city manager, or his designee, may deny any application if in his judgment, the granting of the requested permit would be contrary to the public interests, or would result in unreasonable discomfort or serious inconvenience to persons residing or businesses operating in the vicinity, or if the proposed location is an inappropriate one, or if the event will conflict with any city sponsored or cosponsored event.
