5-4-1: DEFINITIONS:¶
The following words, terms and phrases when used in this chapter have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
HANDBILL: Includes any printed or written advertising matter, any sample or device, dodger, circular, leaflet, pamphlet, newspaper, paper, booklet or any other printed matter or literature.
PERSON: Includes any person, firm, partnership, association, corporation, company or organization of any kind. (Ord. 210, 6-4-1940)
5-4-2: PUBLIC NUISANCE DECLARED:¶
The city council thereby finds and determines that entire communities within the city and a considerable number of citizens are adversely affected by persons, without consent or license, throwing, casting, distributing, scattering and depositing handbills, dodgers, circulars, newspapers, booklets, posters, printed matter and advertising literature upon public or private property in such manner as to allow the material to blow or scatter, thereby causing a littering problem. Such acts are hereby declared to constitute a public nuisance. (Ord. 587, 11-15-1977)
5-4-3: RESTRICTIONS ON DISTRIBUTION:¶
A. Public Property: It shall be unlawful for any person, either directly or indirectly, to deposit, place, throw, scatter or cast any handbill in or on any public thoroughfare, park, grounds or other public place; the provisions of this subsection shall not be deemed to prohibit the handling, transmitting or distributing of any handbill to any person willing to accept such handbill.
B. Vehicles: It shall be unlawful for any person, either directly or indirectly, to distribute, deposit, place, throw, scatter or cast any handbill in or upon any automobile or other vehicle; the provisions of this subsection shall not be deemed to prohibit the handing, transmitting or distributing of any handbill to the owner or other occupant of any automobile or other vehicle. C. Private Property: It shall be unlawful for any person, either directly or indirectly, to distribute, deposit, place, throw, scatter or cast any handbill in or upon any private yard, grounds, walk, porch, steps, mailbox, vestibule, house, residence, building or any other private property in such a manner as to allow the matter to scatter or blow, thereby causing a littering problem; the provisions of this subsection shall not be deemed to prohibit the handling, transmitting or distributing of any handbill to the owner or other occupant of said private yard, grounds, walk, porch, steps, mailbox, vestibule, house, residence, building or other private property with his consent. 5-4-4: POSTING PROPERTY:¶
It shall be lawful for the owner or the occupant of any property to place a sign in a conspicuous place near the entrance thereof indicating that no handbills are desired; and it shall be unlawful for any person to go upon said premises so posted and distribute, deposit, place, throw, scatter or cast any handbill. 5-4-5: HOURS OF DISTRIBUTION:¶
It shall be unlawful for any person to distribute any handbill between the hours of five o'clock (5:00) P.M. of any day and eight o'clock (8:00) A.M. of the following day. (Ord. 210, 6-4-1940)
5-4-6: EXEMPTIONS:¶
The provisions of this chapter shall not be deemed to apply to the distribution of the United States mail nor to the delivery of any handbill to any person who has requested delivery of the same. (Ord. 210, 6-4-1940)
5-4-7: POLITICAL AND RELIGIOUS LITERATURE:¶
Notwithstanding any other provision of this chapter, nothing in this chapter shall be construed to limit the distribution of political and religious literature to persons willing to receive the same or to limit the placing of such literature on private property within the vestibule or outer door of a home in such a manner as to prevent the material distributed from blowing or scattering.
