11.10.010: WAIVERS AUTHORIZED:¶
A. As required by Section 66428(b) of the Subdivision Map Act, this Chapter establishes rules, regulations, and specifications for waivers of a parcel map for division of land either for lease, sale, or financing into four parcels or less hereafter made within the City or as may be annexed to the City.
B. Waiver of the requirement to prepare and file a final parcel map otherwise required under Chapter 11.08 (Parcel Map) of this Title may be authorized if the proposed division of land satisfies all the requirements and criteria established in Section 11.10.020 (Application).
C. The waiver, if granted, shall apply only to the requirements for preparation, filing and approval of a final parcel map as specified in Section 11.08.040 through Section 11.08.060 of this Title; it shall not waive any other requirements applicable under Chapter 11.08 (Parcel Map) of this Title or other provisions of this Title, including, without limitation, the requirement for preparation, filing and processing a tentative parcel map. 11.10.020: APPLICATION:¶
Application for a final parcel map waiver shall be made to the Community Development Director on a separate form prescribed by the Community Development Department. The application shall be in addition to, and shall be submitted with, the tentative parcel map, tentative parcel map application and other submittals and information specified in Section 11.08.140 (Final Parcel Map Application and Filing), of this Title. The application shall contain or have appended to it all information prescribed by the Community Development Department. (Ord. 2024-002, 9-20-2024)
11.10.030: PROCEDURES AND REQUIRED FINDINGS:¶
A. The application for a final parcel map waiver shall be subject to the same procedures for acceptance, review and approval as the tentative parcel map and tentative parcel map application set forth in Section 11.08.040 through Section 11.08.060, of this Title, inclusive, subject to the following:
B. The Planning Commission shall act on the application for final parcel map waiver no later than sixty (60) working days (excluding City recognized holidays) after the application has been accepted as complete by the Community Development Director in compliance with Section 11.08.040 through Section 11.08.060, of this Title, even if the Planning Commission's consideration and action on the tentative parcel map application is at a different time pursuant to Section 11.08.080 (Planning Commission Action), of this Title; and
C. Before approval of a final parcel map waiver, the Planning Commission shall make each of the findings required by Section 66428(b) of the Subdivision Map Act. These findings shall be in addition to, but may be combined with, the findings required for approval of the tentative parcel map.
D. The action of the Planning Commission on the application for final parcel map waiver shall be subject to appeal pursuant to Section 11.08.090 (Appeals), of this Title. (Ord. 2024-002, 9-20-2024)
11.10.040: IMPROVEMENTS:¶
As a condition of approving waiver of a final parcel map, the Planning Commission shall require the subdivider to install, construct, and/or provide all onsite and offsite improvements and the dedication of rights of way or easements required under Chapter 11.08 (Parcel Map) of this Title for the tentative parcel map covering the parcels being created. If a parcel map improvement agreement is required under Subsection 11.08.130 (Improvements), of this Title, the certificate of waiver shall not be issued until the agreement and required security has been filed with and approved by the City Council and City Engineer. 11.10.050: CERTIFICATION OF WATER:¶
When the Planning Commission has found and determined that a division of land qualifies for a final parcel map waiver, and subject to the applicant's compliance, the Community Development Department shall issue a certificate of waiver to the applicant. The applicant shall record such certificate concurrently with the deed, contract of sale or lease of any portion of the property. A copy of both recorded documents shall be filed with the Community Development Department before the certificate shall become final. (Ord. 2024-002, 9-20-2024)
