3-10-1: STATUTORY AUTHORITY:

This chapter is enacted pursuant to the authority of Penal Code sections 12070 and 12071 which require that businesses engaging in the sale of firearms be licensed by the local agency as well as by state and federal authorities. Except as otherwise provided herein, words, forms and phrases used in this chapter shall have the same definitions as in Penal Code sections 12070 and 12071. (Ord. 747, 2-26-1991)

3-10-2: LICENSE REQUIRED:

No person who is required to be licensed by state and federal laws as a condition to the sale of firearms shall engage in the sale of firearms in the city without first having obtained a license, as described in this chapter, from the chief of police. (Ord. 747, 2-26-1991)

3-10-3: APPLICATION:

The applicant shall complete a form prescribed by the chief of police. The data provided by the applicant shall include all information determined necessary by the chief of police to evaluate the applicant's request with respect to the factors to be considered in issuance of a license. (Ord. 747, 2-26-1991)

3-10-4: CONDITIONS FOR LICENSE:

Factors to be evaluated prior to the issuance of a license are:

A. Security of business premises.

B. Compliance of premises with building codes, zoning laws and regulations of the city 1 .

C. Criminal history of applicant.

D. Reputation of applicant for honesty and integrity.

E. Number of local firearms dealers presently in operation.

F. Whether the applicant has obtained a city business license.

G. Whether the applicant is otherwise in compliance with state and federal laws. (Ord. 747, 2-26-1991)

3-10-5: LICENSE PERIOD:

Licenses will be valid for a period of one year from the date of issuance and shall be revoked by the chief of police if it is determined that conditions have changed with regard to licensee's compliance with factors used in evaluating issuance of permit. (Ord. 747, 2-26-1991)

3-10-6: FEES:

A fee will be established by resolution of the city council to reimburse cost for processing applicant license. (Ord. 747, 2-26-1991)
