Note: Sections 4-19.03 through 4-19.08, codified from Ordinance No. 1998 c.s., as amended by Ordinance No. 2240 c.s., effective June 21, 1978, were repealed by Ordinance No. 2594 c.s., effective August 16, 1990. § 4-19.01. Definitions.

For the purpose of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows:

"Bench"

shall mean any seat located upon public property along any public way for the comfort, convenience, or accommodation of passersby or persons awaiting transportation.

"Street or public way"

shall mean any public thoroughfare or way, including the sidewalk, parkway, and any other public property bordering thereon.

§ 4-19.02. Prohibited activities.

(a) It is unlawful for any person, firm, corporation, or association to install or maintain any bench on any street or public way within the City, except that City may install and maintain such benches at such locations as it deems convenient for persons awaiting transportation.

(b) Notwithstanding the foregoing provisions set forth in subsection (a), any person, firm, corporation, or association currently in possession of a valid permit to install and maintain such benches may do so, as provided in the permit, including the display of advertising matter, until the expiration date of the permit. The License Collector shall not issue any new permits nor approve any renewal requests as of the effective date of the ordinance codified in this chapter.

§ 4-19.03. Interference.

It is unlawful for any person, firm, corporation, or association, with the exception of the City, to tamper with, move, injure, deface, or commit acts of vandalism upon any bench upon a public way.
