8.40.010 - Intent.¶
In order to prevent vandalism and unauthorized use of city parks and properties, certain restrictions in and for use of city-owned properties are deemed necessary and proper.

8.40.020 - Definitions.¶
The general definitions set forth in Title 1 of this code shall apply to this chapter. "Public lands or public properties" as used in this chapter mean city lots, city parks, public works areas, and other realty owned by the city.

8.40.030 - Restrictions.¶
A. Unless written permission is received in advance from the city administrator or a city employee authorized to grant such permission, it is unlawful for any person to:
Camp or remain overnight on city property;
Be present in or on any city property, with the exception of public streets, from one hour after sunset to one hour before sunrise;
Drive motor vehicles in areas other than in areas designated for vehicle use and parking;
Discharge firearms, use bows and arrows, or use or discharge any other device which discharges projectiles of any kind, including but not limited to slingshots and paintball guns;
Build fires in other than designated areas.
B. Notwithstanding the foregoing, the restrictions set forth in subsection A of this section shall not apply to: (1) city employees or agents in the performance of their official duties; (2) meetings of the city planning commission, city council, or other bodies, boards, or committees of the city of Portola; or (3) city facilities which are operated and kept open later than one hour after sunset or earlier than one hour before sunrise.

8.40.035 - Use of the city skate park.¶
A. As used in this section, the term "skate park" means the skate facility owned and operated by the city of Portola in the Portola Park that is identified by sign as the "Portola Skate Park."
B. Any person riding, skating, propelling or using a skateboard, roller skates, in-line skates or similar device at the skate park shall wear a helmet, elbow pads, and knee pads at all times.
C. Any person who rides, skates, propels or uses a skateboard, roller skates, in-line skates or similar device at the skate park without the required protective gear is guilty of an infraction, and is punishable in accordance with the provisions of Chapter 1.08 herein.

8.40.040 - Violation and penalties.¶
Violation of any of the provisions of this chapter is a misdemeanor and punishable by imprisonment of six months, or a fine of one thousand dollars, or both.
Should any portion of this chapter be declared void or invalid for any reason, the remaining portion shall remain enforceable.
