Sec. 58-601. - Definitions.¶
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Roller skates and inline skates, including roller blades, means any shoe, boot or other footwear to which one or more wheels is attached.
Skateboard means any platform of any composition or size to which two or more wheels are attached and which is intended to be ridden or propelled by one or more persons standing or kneeling upon it and to which there is not affixed any seat or any device or mechanism to turn and control the wheels.

Sec. 58-602. - Purpose.¶
The purpose of this article is to prohibit the riding of skateboards, roller skates or inline skates or other similar device on and along sidewalks, walkways, roadways and parking areas and other areas open to the public on certain public property and private property when such activity endangers pedestrians and motorists. The city council finds that the practice of such activities, which is increasing, within and upon such areas creates physical hazards to the health and safety of pedestrians and motorists.

Sec. 58-603. - Exemptions.¶
This article shall not apply to any device designated, intended or used solely for (i) the transportation of infants or disabled or incapacitated persons, or (ii) the transportation and containment of goods or merchandise to and from the place of purchase or storage. Furthermore, the community services director may, by resolution, suspend the enforcement of this article to accommodate special events when so requested by the event organizer pursuant to section 46-561.

Sec. 58-604. - Enforcement; violations.¶
This article shall be enforced by any sworn police officer or private security patrol officer whose training and credentials have been approved by the police department. A violation of this article shall constitute an infraction.

Sec. 58-605. - Signage and posting requirements.¶
Signs prohibiting the activities described in this article shall: (i) be placed and posted in conspicuous and visible areas; (ii) have a dimension of not less than one square foot in area, with lettering of not less than one inch high; (iii) state that such activities are prohibited on the property; and (iv) cite the respective section of this Code being invoked, in order to provide reasonable notice. The required signs must be posted prior to the application and enforcement of this article. The required signs shall be continually maintained by the property owner or management. An example of a sign written in compliance with this section reads as follows:

Sec. 58-606. - Withdrawal from application of article.¶
The owner, manager or other person in charge of a private property or shopping center may withdraw the property or center from the application of this article by removing the signs required by sections 58-610 and 58-611 and notifying the chief of police in writing of such withdrawal.

Sec. 58-607. - Use on or along Civic Center Plaza.¶
No person shall ride, operate or utilize any skateboard, roller skates, inline skates, or any other similar device, whether powered by human or motorized means, or propel or use any coaster or toy vehicle on or along any sidewalk, pedestrian walkway, roadway, or parking lot of Civic Center Plaza, an area bounded by Mission Boulevard to the north, Seventh Street to the south, Garey Street to the east, and Park Street to the west.

Sec. 58-608. - Use on or along commercial zoned areas.¶
No person shall ride, operate or utilize any skateboard, roller skates, inline skates, or any other similar device, whether powered by human or motorized means, or propel or use any coaster or toy vehicle on or along any sidewalk, pedestrian walkway, roadway, or parking lot of any commercially zoned area within the city as such commercial zone area is defined in this Code.

Sec. 58-609. - Use in city-owned parking lots, garages, or other parking facilities.¶
No person shall ride, operate or utilize any skateboard, roller skates, inline skates, or any other similar device that is propelled by human or motorized means or propel or use any coaster or toy vehicle upon any city-owned, city-operated or city-controlled parking lot, garage, or other parking facilities.

Sec. 58-610. - Use on private property open to the public.¶
No person shall ride, operate or utilize any skateboard, roller skates, inline skates, or other similar device that is propelled by human or motorized means or propel any coaster or toy vehicle upon any privately owned, operated, or controlled property open to the public without first obtaining the consent of the property owner, his designee, or a lawful occupant. In addition, the property owner is authorized to post or erect signs at the owner's expense prohibiting the riding of the devices described in this section in or on those premises, if a request has been made and approved by the chief of police, in accordance with established sign standards described in section 58-605.

Sec. 58-611. - Use on pedestrian walkways or parking areas within commercial shopping…¶
No person shall ride, operate or utilize any skateboard, roller skates, inline skates, or other similar device that is propelled by human or motorized means or propel any coaster or toy vehicle upon any pedestrian walkway or parking area within a commercial shopping center or store. This section shall not apply unless and until the owner, manager or other person in charge of the shopping center or store shall have accomplished the signage and posting requirements of section 58-605. The owner, manager or other person in charge of the shopping center shall deliver a written notification to the chief of police, not less than 24 hours prior to posting the signs described in section 58-605, that the shopping center is invoking this section as of a certain date which shall be specified in the notice.

Sec. 58-612. - Facilities for trick riding.¶
No person shall erect, construct, or place any ramp or similar device for the purpose of performing or allowing to be performed any acrobatic, fancy, stunt, or trick riding on or along any city street, sidewalk, or property or facility owned, operated, or controlled by the city.
