Sec. 58-381. - Created.¶
There is created, pursuant to Streets and Highways Code § 31770.1, a board of parking place commissioners which shall have all of the powers and duties of boards of parking place commissioners under the Vehicle Parking District Law of 1943 (Streets and Highways Code § 31500 et seq.).

Sec. 58-382. - Composition and appointment of members.¶
There shall be seven members of the board of parking place commissioners. Each member thereof shall be appointed by the city council.

Sec. 58-383. - Qualifications of members.¶
It is intended that the board of parking place commissioners shall be persons of business experience and knowledge of the city's downtown activities to the end that the affairs of the vehicle parking district shall be administered in the interests of the district. A commissioner may be an owner or lessee of property or an officer, employee or agent of a sole proprietorship, partnership or corporation owning or leasing property within the district or similarly qualified person; provided, however, all commissioners must be residents of the city and must also meet the qualifications required by section 801 of the Charter. Any such commissioner, however, shall not vote upon or influence in any manner a decision of the commission or council which relates particularly to the commissioner's property or business or which affects the commissioner's property or business more than other properties or businesses in the district or take action which is a violation of the laws relating to conflicts of interest, pursuant to the Political Reform Act of 1974 (Government Code § 87100 et seq.).

Sec. 58-384. - Terms of office; selection of chair.¶
(a) The term of office of each member of the board of parking place commissioners shall be four years. The term of commissioners appointed by the city council shall coincide with the councilmember's term of office and shall end concurrently with the ending of the term of the councilmember/mayor who nominated that commissioner. However, in no event shall a commissioner serve for a period longer than the term of the councilmember/mayor who nominated that commissioner. Each member serves until his successor is appointed and qualifies or until the city council vacates that commissioner's office.
(b) The board of parking place commissioners shall elect one of its members as chair and one member as vice-chair of the board to serve for one year. During the absence of the chair, the vice-chair shall act as the chair.

Sec. 58-385. - Removal of members.¶
(a) Any member of the board of parking place commissioners may be removed by a majority vote of the entire city council when, in the discretion of the city council, the best interests of the city will be served thereby.
(b) The city council shall remove a commissioner, pursuant to Streets and Highways Code § 31778, whenever a petition signed by the owners of more than one-half of the area of assessable land within the vehicle parking district requesting the removal of the commissioner is filed with the city council. The commissioner removed is ineligible to hold office as a commissioner of the vehicle parking district for one year following the commissioner's removal.
(c) If a member is absent without cause from three successive regular meetings of the board, the city clerk shall declare his position to be vacant and shall notify the city council. A member is not absent without cause if the absence is:
(1) Due to illness; or
(2) Unavoidable and the member gives the secretary of the board notification before the day of the meeting that he will be absent and states the reason for the absence.
(d) Whenever a vacancy occurs, the city council shall fill the vacancy in the same manner as was used for the original appointment. A member appointed to fill a vacancy serves for the remainder of the unexpired term.
