Sec. 46-91. - Specifications; approval.

Every driveway, entrance or exit constructed or established connecting a street with private property, wherever curb and sidewalk are maintained, shall have a floor not less than six inches in thickness, and such driveway shall be continued from such sidewalk on a straight line gradient through a cut in the curb to the flow line of the gutter of such street. All such construction shall be subject to the approval of the director of public works/city engineer. The director of public works/city engineer shall approve such construction as complies with all laws and ordinances.

Sec. 46-92. - Location.

Every driveway, entrance or exit constructed or established connecting a street with private property shall be so constructed or established that no portion of such driveway, entrance or exit shall approach or pass within six feet of any fire hydrant.

Sec. 46-93. - Width.

Every driveway, entrance or exit constructed or established connecting a street with private property wherever curb and sidewalk are maintained shall be restricted in width overall to 50 percent or less of the frontage of that portion of such private property as is directly involved in the use of the driveway. However, if, in the discretion of the city council sitting as a body in regular or adjourned session, such restriction as to overall width of such driveway, entrance or exit will endanger the public in person or property or interfere with the public convenience in the use of the sidewalk and street, the council may waive the restriction as to the overall width. Private convenience in the use of such driveway shall not be the basis for the waiving of the restriction as to overall width.

Sec. 46-94. - Noncompliance with terms.

On the failure of the permittee, owner or lessee to remove or replace, as provided in section 46-120, any driveway, entrance or exit, the use of which has been vacated or abandoned for 90 days, the director of public works/city engineer shall so report to the city council, and the council may instruct the director of public works/city engineer to abate such hazardous or inconvenient condition in the manner provided by law.
