Sec. 34-111. - Responsibility of parent.¶
(a) Any parent, foster parent, guardian or other person having the legal care and custody of any child under the age of 18 years who allows, permits or suffers such child to fire, shoot, discharge, set off or explode any torpedo, rocket, firecracker, squib or blank cartridge, or any fireworks whatsoever or anything containing any portion of chloride of potash, mixture of sulfur, saltpeter, or any substance of any explosive nature, except paper caps as defined in section 34-112(a), is guilty of a misdemeanor.
(b) Any parent, foster parent, guardian or other person having the legal care and custody of any child under the age of 18 years who allows, permits or suffers such child to possess paper caps on the premises of any public place shall be guilty of a misdemeanor.

Sec. 34-112. - Discharge generally.¶
(a) Any person who fires, shoots, discharges, sets off or explodes any torpedo, rocket, firecracker, squib, fireworks, blank cartridges, or anything containing any portion of chloride of potash, mixture of sulfur or saltpeter, or any substance of any explosive nature, except toy torpedoes specifically designed for use only with toy pistol caps as defined in section 34-112(b) containing not more than 0.25 grain of explosive compound to each paper cap, is guilty of a misdemeanor.
(b) For purposes of this division, "paper cap" shall mean anything containing any portion of chloride of potash, mixture of sulfur or saltpeter, or any substance of any explosive nature containing not more than 0.25 grain of explosive compound to each charge, which is specifically designed for use with a toy percussive device to ignite or set off such charge, regardless if such charge is packaged and/or sold as single charges encased in paper or plastic or in a roll, strip, or other package.
(c) Any person who discharges a paper cap as defined in section 34-112(b) in the public right of way, in any public place, or in any other place other than that person's place of residence, except where such person has the express authority of the owner of such other private premises, shall be guilty of an infractoin.

Sec. 34-113. - Sale.¶
(a) Any person who sells, gives away, canvasses, or solicits for the sale of any torpedoes, rockets, firecrackers, squibs, blank cartridges, or any fireworks whatsoever, except paper caps as specified in section 34-112(b), is guilty of a misdemeanor.
(b) No person shall sell smoke bombs, stink bombs, or cap balls, or paper caps, as defined in 34-112(b), to any person under the age of 18 years of age prior to 3:15 p.m. each weekday.

Sec. 34-114. - Enforcement; penalties.¶
(a) The chief of police or his or her designee, upon determining a violation of this division, may issue an administrative citation, in accordance with section 2-1184, to the responsible party, person leasing or occupying the property or the property owner of where the firework was observed or discharged.
(b) The city council may establish an administrative fine for violations of this division by separate resolution.
