Pomona Municipal Code § 2-311 Short title

Sec. 2-311. - Short title.

This division shall be known as, and when cited, referred to, or amended, may be designated as the "Pomona Personnel System Ordinance."

Sec. 2-312. - Purpose of division.

The purpose of this division is, first, to establish a system for the selection and promotion of employees of the city, on the basis of merit, experience and record, in order to secure and retain the most efficient and courteous public employees to handle the city's business and administer its affairs; second, to provide worthy officials and employees reasonable security in the retention of their respective positions and afford them an opportunity for advancement according to merit.

Sec. 2-313. - Applicability.

The provisions of this division shall apply to all offices, positions and employments in the service of the city except:

(1) Positions on appointive boards, commissions or committees.

(2) The head of each department.

(3) Elective officials.

(4) Temporary employees in an office or department of the city who shall not be entitled to any additional benefits other than legally required.

(5) Regular part-time employees who shall not be entitled to any additional benefits other than those legally required.

(6) Volunteer personnel.

(7) Persons employed under contract to supply expert professional or technical services for a definite period of time or fixed fee.

(8) Officers and employees of the Los Angeles County Department of Public Health and Welfare engaged in the enforcement of public health and welfare and also engaged in the enforcement of public health regulations in the city.

(9) Disaster volunteers appointed pursuant to the Pomona Disaster Ordinance.

(10) Emergency employees in any office or department of the city. All such positions and employments shall be for the duration of the emergency and shall terminate immediately thereafter.

All offices, positions and employments not exempted in this section shall constitute the classified service of the city.

Sec. 2-314. - Human resources/risk management director—Created.

There is hereby created the position of human resources/risk management director who shall serve under the direction of the city manager, who is designated as the chief personnel officer by Section 603(b) of the Charter of the city.

Sec. 2-315. - Same—Duties.

The human resources/risk management director shall have the responsibility of making effective the purposes of this division and, in addition to other responsibilities, it shall be his/her duty, or the duty of his/her delegated subordinate:

(1) To administer all provisions of this division and regulations established hereunder not specifically reserved for the city council.

(2) To establish and keep a roster of all officials and employees in the classified service and all personnel records, which records shall show the length of time each officer and employee has been therein, together with a concise statement of all the duties performed and the salary paid. He/She shall keep such additional data in connection therewith as the city council may require.

(3) To recommend a plan for the specification and classification of positions to the city council. After the adoption of such classification plan, the human resources/risk management director shall allocate and reallocate the various positions according to the respective classes to which they belong under the direction of the city manager.

(4) To prepare and recommend a set of rules and regulations (personnel rules) for the administration of the personnel system, which rules and regulations may be revised or amended from time to time as the occasion demands by the city manager.

Sec. 2-316. - Abolishing and consolidating positions.

Whenever in the judgment of the city council it becomes necessary in the interest of economy or more efficiency, or because the need of the position involved no longer exists, the city council may abolish an office or employment in the classified service, and lay off, demote or transfer the employee holding such position or employment. Nothing herein shall be deemed to prohibit the city council from combining or consolidating any office or employment with some other position in the interest of economy or greater efficiency.
