Pomona Municipal Code § 2-1 Holidays

Sec. 2-1. - Holidays.¶
Legal holidays, for purposes of this Code, shall be as established by resolution. For purposes of personnel regulations, holidays shall be as established in collective bargaining agreements or in personnel rules.

Sec. 2-2. - Office hours generally.¶
City hall offices shall be open to serve the public as set forth by resolution of the council.

Sec. 2-3. - Offices closed on Saturdays, Sundays and holidays.¶
All city hall offices shall be closed on Saturdays, Sundays and such legal holidays as are established by the city council.

Sec. 2-4. - Waiver of application fees.¶
Whenever this Code or any other ordinance adopted by the city council requires that a fee be paid as a condition for obtaining a permit, change of zone, variance, conditional use permit, minor deviation, building permit or any other privilege subject to approval of any officer, commission, board or the city council, such fee may be waived by the city council if such applicant presents evidence sufficient to satisfy the city council that the payment of such fee would work an extreme hardship on the applicant and that the waiving of the fee would be in the best interest of the public in order to permit the applicant to proceed in the processing of the application.

Sec. 2-5. - City seal, flag, emblem and public library logo.¶
The common seal of the city, city flag, emblem and Pomona Public Library Logo described below are adopted as the official seal, flag, emblem and public library logo of the City of Pomona as follows: [Figure: City Seal]

Pomona Public Library Logo
(1) Official custodian. The city clerk shall be the official custodian of the seal, flag and emblem of the City of Pomona.
(2) Adoption and description. The existing seal, flag, and emblem of the City of Pomona, the impresses of which are on file with the city clerk's office, and descriptions of which are shown below, are adopted as the official seal, flag and emblem of the City of Pomona. The official seal of the City of Pomona is also registered as a trademark with the State of California. The existing Pomona Public Library logo, the impress of which is on file with the city clerk's office, and description of which is shown below, is adopted as the official logo of the Pomona Public Library. The city clerk shall be the official custodian of the Pomona Public Library logo and the seal, flag and emblem of the City of Pomona.
a. Seal. The city seal is a design used to identify documents as an official act of the city council, or to identify certain real or personal property as the official real or personal property of the City of Pomona. The seal of the city shall be circular in form, approximately two inches in diameter, and shall bear upon its face the following design: In the center thereof, stands the Goddess of Pomona, depicted with green hair and adorned in a blue gown, bearing in her left hand a brown staff that extends just above shoulder length. On her left elbow, hangs a leash attached to a brown canine, which stands facing the right side of the seal to her immediate left. Her right hand rests upon an overturned horn that bears multi-colored fruit and vegetables that pile in front of her feet. Immediately above the Goddess, the seal bears in black writing, "California." In the blue colored circumference encircling the Goddess shall be, in white, two stars, one each to the immediate left and right of the goddess and the words, "City of Pomona" on the upper portion, and, "Incorporated Jan. 1888" on the lower portion. The circumference has a rope-like border, red and white in color, on both the inner and outer circles, the outer border measuring wider than the inner border. The center portion of the seal contains a shading effect that fades from blue to white beginning at the inner portion of the circumference and fading towards the image of the goddess in the center. The seal may be depicted in colored form or a black and/or white rendition of this same description.
b. Flag. The city flag is a design used for ceremonial purposes to represent the corporate entity and jurisdiction of the City of Pomona. The flag of the city shall be rectangular in form and proportionate to the measurements of three feet wide by five feet high of the same measuring unit. The flag is royal blue in color, bearing a white bar that measures approximately six-inches wide on a standard three-foot by five-foot flag, spanning from top to bottom on the far left portion of a flag, and a gold bar of equal measurement to the immediate right of the white bar. The center of the flag shall bear a white rendering of the city seal. Immediately above the seal, the flag shall bear, in arched fashion, "POMONA" in gold block lettering.
c. Emblem. The city emblem is a design used for the purpose of representing the corporate entity and jurisdiction of the City of Pomona and the capacity of its officers, employees and agents as representatives of the City of Pomona. The general design and the details of the city emblem, excluding colors, shall correspond substantially with the following representation thereof: The emblem of the City of Pomona shall consist of six uppercase letter "P" in a weighted roman style font arranged in a circular fashion, approximately two inches in diameter, in a manner that the base of the letters create a hexagonal shape in the center of the logo. This emblem may be depicted in any color or in the form of an impression.
d. Pomona Public Library logo. The Pomona Public Library logo is a design used to identify documents, real or personal property as official documents, real or personal property of the Pomona Public Library. The logo of the Pomona Public Library shall be circular in form, approximately two inches in diameter, and shall bear upon its face the Goddess of Pomona, depicted in a dark red color with white highlights, bearing in her left hand a staff that extends just above shoulder length. On her left elbow hangs a leash attached to a canine, which stands facing the right side of the seal to her immediate left. Her right hand rests upon an overturned horn that bears fruit and vegetables that pile in front of her feet. The circumference of the logo bears the words "Pomona Public Library" in white block letters with black outline.
(3) Unauthorized use of logo, seal, flag, and/or emblem—Penalty.
a. It is unlawful for any person to make or use the seal of the city, or reproduction thereof, for any purpose other than for the official business of the city, its council, officers or departments.
b. No person shall use the city emblem or Pomona Public Library logo, or any facsimile thereof, for purposes of supporting or opposing the nomination or election to any city or other public office of any person, or for purposes of supporting or opposing any ballot measure, nor include such city emblem on any writing distributed for purposes of influencing the action of the electorate, or any part thereof, in any election. This section shall not be applicable to writings issued by the City of Pomona.
c. (1)
Whoever knowingly displays any facsimile of the seal, flag, and/or emblem of the City of Pomona, or the Pomona Public Library logo, in connection with, any advertisement, poster or circular, for the purpose of conveying, or in a manner reasonably calculated to convey, a false impression of sponsorship or approval by the City of Pomona or by any department, agency or instrumentality thereof, shall be guilty of a misdemeanor.
(2) Subdivision (1) shall not be construed to apply to the use of a facsimile of the seal, flag or emblem or Pomona Public Library logo in any newspaper, periodical, book, pamphlet or stationery where the facsimile of the seal is printed for informational purposes only to indicate that any article or printed matter therein originated from authorized sources of the City of Pomona.
d. (1)
Whoever, except when authorized in writing by the city council for official use of the city, knowingly manufactures, reproduces, sells or purchases for resale, either separately or appended to any article manufactured or sold, any facsimile of the seal, flag or emblem of the City of Pomona, or the Pomona Public Library logo, or any substantial part thereof, or otherwise displays same for unauthorized purposes or the purpose of personal financial gain shall be guilty of a misdemeanor.
(2) As used in this subsection, the term "sell" shall be broadly construed to include transactions involving monetary donations to the seller and/or the seller's agent or representative.
e. As used in this subsection, the term "facsimile" shall mean a replica of the seal, flag, emblem or logo as described in subsection 2-5(2) of this article.
(4) Manufacture and sale of souvenirs and decorative items. Nothing in this article shall prevent a person from manufacturing or selling non-documentary objects, such as souvenirs or decorative items, bearing the city seal and/or emblem or Pomona Public Library logo as part of the design, provided that such person undertakes such activity pursuant to agreement with the city, approved by the city council or by such officer as the city council may designate, containing such requirements and limitations as the city council or such officer shall deem appropriate to assure that such use of the city seal, Pomona Public Library logo and/or city emblem is in the best interests of the City of Pomona.
