12.04.010 When required.

Any owner, lessee or agent constructing or arranging for the construction of a building or dwelling or moving of a building or dwelling upon a lot shall also construct or cause to be constructed concrete curbs, gutters and sidewalks in accordance with specifications set forth in this chapter, unless concrete curbs, gutters and sidewalks already exist along all street frontages adjoining the lot or lots on which the building or dwelling is to be constructed; provided, however, that in areas not subdivided or parceled into one-half acre or smaller lots, curb and sidewalk need not be installed for a greater distance than the minimum lot width required by the zoning regulations for the zone in which said area is located. For corner parcels in such unsubdivided areas, the side frontage shall be determined by the minimum area requirements. (Prior code § 12.04.010)

12.04.020 Residential district specifications.

All curbs in residential districts shall be constructed in accordance with city specifications and all sidewalks in residential districts shall be four and one-half feet from the base of the curb to the back of the sidewalk and poured integrally, unless the new sidewalk to be so constructed is to be determined by resolution of the council upon application by the owner, lessee or agent desiring to construct said sidewalk or by the director of public works of the city. 12.04.030 Commercial district specifications.

All curbs in commercial districts are to be constructed in accordance with city specifications and all sidewalks in commercial districts shall be a width of ten feet from the face of the curb to the back of the sidewalk if the existing sidewalk in the block in which said new sidewalk is to be constructed is of the same width; if the existing sidewalk in the block in which the new sidewalk is to be constructed is not of a ten foot width, then the new sidewalk to be constructed will be of the same width as the existing sidewalk already in place in the block. 12.04.040 Exclusions.

Notwithstanding the requirements specified in Sections 12.04.020 and 12.04.030, no owner, lessee or agent constructing or arranging for the construction of a building or dwelling or moving of a building or dwelling upon a lot in a residential district, other than a new subdivision, shall be required to construct or cause to be constructed concrete curbs, gutters and sidewalks, unless the city has provided for the establishment of grades in accordance with appropriate engineering specifications at the time of such construction. 12.04.050 Denial of certificate of occupancy.

The director of public works of the city shall deny final public utility connections to any building or dwelling in the certificate of occupancy until the concrete curbs, gutters or sidewalks exist or are constructed or their construction is guaranteed to the satisfaction of the council. (Prior code § 12.04.040)

12.04.060 Violation—Penalty.

If any person, firm or corporation violates any provision of this chapter, is guilty of a misdemeanor, and shall be punishable by a fine of not more than five hundred dollars or by imprisonment in the county jail for a period not to exceed six months or by both such fine and imprisonment.
