For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows: (a) “Bicycle” shall mean any device upon which a person may ride, which is propelled by human power through a system of belts, chains, or gears and which has wheels at least twenty (20) inches in diameter and a frame size of at least fourteen (14) inches. (a) It shall be unlawful for any person to operate or use a bicycle in the City which is not currently licensed by the City pursuant to the provisions of this chapter or by some other City or County in the State; provided, however, this subsection (a) shall not apply to bicycles owned by persons who are not residents of the State. (b) It shall be unlawful for any person residing in the City to operate in the City a bicycle which is required to be, but which is not, currently licensed by the City. (c) Any person residing in the City who, upon the effective date of this section, owns a bicycle which is usually kept within the City shall obtain a registration certificate and a license plate (decal) for such bicycle from the Police Department within thirty (30) days after the effective date of this section. (d) Any person residing in the City who, after the effective date of this section, acquires a bicycle to be kept in the City shall obtain a registration certificate and a license plate (decal) for such bicycle from the Police Department

(a) The Police Department shall obtain original bicycle license plates (decals) and renewal license plates (decals) from the Department of Motor Vehicles of the State pursuant to Division 16.7 of the Vehicle Code of the State. (b) Registration certificates and license plates (decals) will be issued by the Police Department in accordance with the provisions of this chapter and upon application by prospective licensees. (c) No registration certificate or license plate (decal) shall be issued until the Police Department has determined, upon inspection of the bicycle, that the bicycle is in a safe operating condition and is equipped with all the safety devices required by the laws of the State. (a) The due date for any person owning a bicycle required to be licensed pursuant to the provisions of this chapter shall be January 1, 1975, or the date on which said person first kept the bicycle in the City, whichever date is later. (b) All registration certificates and license plates (decals) issued prior to December 31, 1978, shall expire on December 31, 1978. (c) Any person residing in the City who owns a bicycle required to be licensed by the provisions of this chapter, which bicycle was originally licensed on or before December 31, 1978, shall within thirty (30) days after January 1, 1979, apply to the Police Department for a renewal of the registration certificate and for a renewal license plate (decal). (d) Any person residing in the City who acquires a bicycle required to be licensed by the provisions of this chapter on or after January 1, 1979, shall upon application, and after inspection as provided in this chapter, be issued an original registration certificate and a renewal license plate (decal). (e) Any bicycle which has wheels less than twenty (20) inches in diameter or a frame size less than fourteen (14) inches may be licensed at the request of the owner thereof. Licensing procedures shall be as otherwise set forth in this chapter, with the due date being the date of the application for such license. Once such bicycle is licensed, all of the provisions of this chapter shall thereafter apply to such bicycle. (§ 1(c), Ord. 940, eff. February 4, 1953, as amended by § 3, Ord. 1798, eff. Each license decal shall be affixed to a permanent frame member under police supervision at the time of registration. (§ 1(b), Ord. 940, eff. February 4, 1953, as amended by § 4, Ord. 1798, eff. July 1, 1973)

Upon satisfactory evidence that a license plate (decal) has been mutilated, and upon the presentation of the original certificate of registration, a new license plate (decal) may be issued.

It shall be unlawful for any person to destroy, remove, mutilate, or alter any bicycle license plate (decal); provided, however, an expired or invalid license plate (decal) may be removed by the owner of a bicycle, or by a person authorized by the owner, subsequent to the affixing of a current and valid license plate (decal) to the bicycle. Upon the licensing of any bicycle not having permanent identification numbers, the Police Department may affix permanent identification numbers on the frame of such bicycle. (§ 1(d), Ord. 940, eff. It shall be unlawful for any person to destroy, remove, mutilate, or alter any identification number affixed on a bicycle frame. (§ 1(d), Ord. 940, eff. February 4, 1953, as amended by § 1, Ord. 1878, eff. January 1, 1976, and § 1, Ord. 2724, eff. November 2, 2000)

(a) The owner of any bicycle licensed pursuant to the provisions of this chapter shall report any sale or transfer of ownership of the bicycle to the Police Department within ten (10) days after such sale or transfer. The report shall be in writing and shall contain such information as is required by the Police Department. (b) Any person residing in the City who is a transferee of a bicycle currently licensed by the City in accordance with the provisions of this chapter shall obtain a new registration certificate and license plate (decal) for such bicycle within ten (10) days after such sale or transfer. Each bicycle retailer shall supply each purchaser with a record of the following information: the name and address of the retailer; the year, make, serial number, and general description of the bicycle; and the name and address of the purchaser. The retailer shall forward a copy of such record to the Police Department within ten (10) days after such transaction. (§ 1(c), Ord. 940, eff. February 4, 1953, as amended by § 8, Ord. 1798, eff. No person engaged in the business of renting bicycles for hire shall rent a bicycle to a minor under ten (10) years of age. In renting a bicycle to a minor over ten (10) years of age and under sixteen (16) years of age, the renting agency shall have on file for police inspection the written consent of the parent or guardian of such minor stating that the minor is ten (10) years of age or older and is permitted to rent a bicycle. Whenever the owner of a bicycle licensed pursuant to this chapter changes his or her address, he or she shall, within ten (10) days, notify the Police Department of the old and new address. (a) By minors. Any minor who violates any provision of this chapter shall be reprimanded by the Police Department by a letter addressed to the parent or guardian of such minor. Upon any subsequent violation within a period of three (3) years, the offender shall be summoned to appear at the Police Department with this bicycle and shall be accompanied by a parent or guardian. After a hearing, the Police Department may suspend the offender's privilege to operate and use a bicycle within the City and/or impound the offender's bicycle for a period of not to exceed thirty (30) days. (b) By persons other than minors. Any person, other than a minor, who has been convicted of violating any provision of this chapter shall be punished upon a first conviction by a fine of not more than Five Dollars ($5.00) and, upon a second or any subsequent conviction within three (3) years of a prior conviction, by a fine of Ten Dollars ($10.00). Each motorized bicycle retailer shall post a sign in a conspicuous location upon the business premises, which sign shall contain the following statement imprinted in letters at least one and one-half (1½) inches in height: “A State Driver's License or Instruction (Learner's) Permit Is Required to Operate a Motorized Bicycle on Streets and Highways.” (§ 1, Ord. 1984, eff.
