The Residential Rent Adjustment Program Ordinance is in the Oakland Municipal Code under the Residential Rent Adjustments and Evictions chapter, Article I. Within Chapter 22, you will also find the following articles that regulate the relationship between property owners and tenants:

Article I: Residential Rent Adjustment Program This article explains the rules for rent increases and describes how the Rent Adjustment Program (RAP) petition process works.

Article II: Just Cause for Eviction This article lists the valid reasons (or “just causes”) a property owner must have to end a tenancy and what the notice requirements are.

Article III: Terminating Tenancy to Withdraw Residential Rental Units from the Rental Market This article outlines the process for removing a rental unit from the residential market under the Ellis Act.

Article IV: Rent Program Annual Service Fee This article describes the requirement for property owners to pay the annual RAP service fee.

Article V: Tenant Protection Ordinance This article provides additional protections for tenants against harassment and other harmful practices.

Article VI: Tenant Move-Out Agreement This article explains the rules and requirements for voluntary agreements in which tenants move out in exchange for compensation or other terms.

Article VII: Uniform Residential Tenant Relocation This article outlines when relocation assistance is required and how those payments are calculated.

Article VIII: Relocation Payments for Owner or Relative Move-Ins. This article covers relocation requirements when a property owner or qualifying relative wishes to move into a rental unit.

Article IX: Equitable Access to Low-Income Housing. This article establishes guidelines to ensure fair access to affordable housing opportunities.
