§ 5.16.010. Report of repossessed automobiles required.

Every person who recovers possession or takes possession of any motor vehicle under the provisions of any conditional sale contract, lease contract, chattel mortgage or similar document or agreement, or under color of right of the provisions of any such contract, mortgage, document or agreement, which recovery or taking of possession is termed repossession or repossessing, shall:

A. Within four hours after repossessing such vehicle from any point within the City, make an oral report to the County Sheriff's Station in the City, giving:

  1. His or her name and address;

  2. The make, model, year and license number of such vehicle;

  3. The name and address of the person or agency repossessing the vehicle;

  4. The date, time and exact location of such repossession.

B. Within 24 hours after repossessing such vehicle from any point within the City, complete, execute and file in person at the County Sheriff's Station in the City, and address and mail by certified or registered mail to the registered owner of such motor vehicle, or to the lessee in the case of a lease contract, a form furnished by the Sheriff setting forth the following information:

  1. The make, model, year, motor number, serial number and license number of such vehicle;

  2. The name and address of the registered owner of such vehicle;

  3. The name and address of the legal owner of such vehicle at the time of repossession;

  4. The name and address of the person or agency repossessing the vehicle;

  5. The date, time, and exact location of such repossession; and

  6. Such other information as the Sheriff shall find to be necessary for the identification of vehicles reported to the Sheriff as having been stolen, or necessary for the prevention of fraud in the repossession of motor vehicles.

§ 5.16.020. Effect of failure to report.

No person who shall have failed to make any report required by this chapter within the time prescribed in this chapter shall repossess or attempt to repossess any other automobile in the City for a period of 90 days thereafter. This sanction shall apply in addition to any other penalties provided by law for the violation of Section 5.16.010.
