9.26.020 - Drinking on streets or other public places.

No person shall drink or possess an open container of any beer, wine, or other intoxicating beverage on any street, sidewalk, way, alley, or public parking lot, unless expressly permitted under an encroachment permit issued pursuant to Chapter 12.08 of Title 12 of this code.

This section shall not be deemed to make punishable any act or acts which are prohibited by any statute of the state of California.

9.26.030 - Exemptions.

Outdoor service in restaurants adjacent to any street, sidewalk, way, alley, or parking lot is exempt from this chapter.

9.26.040 - Penalty—Infraction.

Any person who violates any provision of Section 9.26.020 shall be deemed guilty of an infraction.
