§ 3.44.010. Definitions.

As used in this chapter:

"Mello-Roos Act"

means the Mello-Roos Community Facilities Act of 1982 (Chapter 2.5, commencing with Section 53311 of Part 1, Division 2, Title 5 of the California Government Code), as amended from time to time.

§ 3.44.020. Use of the Mello-Roos Community Facilities Act.

A. The City hereby avails itself of the alternative method of financing certain public capital facilities and services as set forth in the Mello-Roos Act. The City Council may authorize the financing of certain public capital facilities or services pursuant to the Mello-Roos Act, whenever the Council determines by resolution that it is necessary or desirable to do so.

B. Whenever the City forms a community facilities district pursuant to this chapter, the City Council shall act as the legislative body for the district.
