§ 8.20.010. Statutory authority.

The county environmental health department of the environmental resource agency is primarily responsible for enforcing within Ventura County those regulations set forth in Title 17, California Administrative Code, Sections 7583 through 7622, relating to safeguarding drinking water supplies by preventing backflow. In order to properly exercise its duties, the environmental health department requires assurance that anyone testing and making reports on backflow prevention devices as required by law is competent to perform those services.

§ 8.20.020. Certification required.

The environmental health department shall periodically conduct examinations to determine the competency of applicants to test and make reports on backflow prevention devices. Those persons who are determined to be competent shall be issued a certificate of competence valid for the duration of three consecutive calendar years commencing with the calendar year in which it is issued, and shall be issued such identification as is deemed by the environmental health director to be appropriate. Any limitations or conditions imposed by the environmental health director on the examinee in the inspection of backflow prevention devices shall be stated upon the face of such certificate issued to the examinee. A certificate of competence relates only to testing and making reports on backflow prevention devices and does not certify competence in cross-connection control. Any person desiring certification shall make written application to the environmental health department. Each application shall be accompanied by a fee, in an amount to be set by resolution of the board of supervisors, which is not refundable; provided, however, that no fee shall be required of a full-time employee of the county whose official duties include the testing of and making of reports on backflow prevention devices.

§ 8.20.030. Reports.

A. All reports of tests of backflow prevention devices required by law shall be filed with the environmental health department, on forms provided by that department, within 20 days of receipt of such forms.

B. The environmental health department shall accept reports required by Title 17, California Administrative Code, Sections 7583 through 7622, from only those persons who possess a valid current certificate of competence.

§ 8.20.040. Renewal.

A certificate of competence may be renewed for an additional three year period at any time in the last quarter of the last year of the current period for which it was issued. The application for a renewal shall be made and processed in the same manner, and shall be subject to the same fee and examination, as an application for an original certificate.

§ 8.20.050. Revocation.

Any person possessing a certificate of competence who violates or fails to comply with any of the provisions of Title 17, California Administrative Code, Sections 7583 through 7622, or who wilfully falsifies inspection reports submitted to the environmental health department, shall, in addition to the penalties otherwise prescribed in this code, have such certificate immediately revoked and shall not be considered for recertification for a period of two years.
