§ 8.12.010. Arrest authority—Generally.

Pursuant to the authority vested in the board of supervisors of the county by California Penal Code Section 836.5, the director of the environmental health agency, and certain of his or her authorized subordinates, as provided in this chapter, shall have the power of arrest without warrant whenever they have reasonable cause to believe that the person to be arrested has committed a misdemeanor, misdemeanor/infraction, or infraction in his or her presence consisting of a violation of the provisions of the county code and the California Health and Safety Code, or any ordinance or statute, which is under the administration of the director of environmental health.

§ 8.12.020. Arrest authority—Designated.

The persons who are authorized to make arrests as provided in this chapter shall consist of the director of environmental health and those of his or her subordinates, as he or she shall designate, who are engaged in inspection and enforcement for the county environmental health division.

§ 8.12.030. Arrest procedure.

In a case in which a person is arrested pursuant to this section and the person arrested does not demand to be taken before a magistrate, the arresting officer shall prepare a written notice to appear and release the person on his or her promise to appear, as prescribed by Chapter 5 (commencing with Section 853.6) of the California Penal Code. The provisions of that chapter shall thereafter apply with reference to any proceeding based upon the issuance of a written notice to appear pursuant to this section.
