11.88.010 - Discharge of firearms or bow and miles of city limits.

Except as provided in Section 11.88.080, no person shall shoot or discharge any firearm or bow and arrow within two miles of the city limits of any incorporated city having a population of five thousand (5,000) or more people within the County of Monterey.

11.88.015 - North County minimum standards

A. No person shall shoot or discharge a firearm within one-quarter mile of a dwelling, school, or place of public assembly within the boundaries of the unincorporated area situate in the County of Monterey, State of California, particularly described as follows:

Beginning at the most northwesterly boundary corner of Monterey County between Monterey County and Santa Cruz County at the Pacific Ocean (Monterey Bay); thence:

  1. Easterly along the boundary line between Monterey County and San Benito County; thence

  2. Southerly along the boundary line between Monterey County and San Benito County to a point one hundred (100) yards southeasterly of and measured at right angles from the intersection with Old Stage road (a County road); thence

  3. Southwesterly, parallel to and one hundred (100) yards southeasterly from the centerline of Old Stage Road (a County road) to a point that is one hundred (100) yards southeasterly of and measured at right angles from the intersection of Crazy Horse Canyon Road (a County road); thence

  4. Northwesterly one hundred (100) yards to the intersection of Old Stage Road and Crazy Horse Canyon Road; thence

  5. Southwesterly along Old Stage Road (a County road) to the intersection of Hebert Road (a County road); thence

  6. Northwesterly along Hebert Road (a County road) to the intersection of San Juan Grade Road (a County road); thence

  7. Southwesterly along San Juan Grade Road (a County road) to the intersection of Russell Road (a County road); thence

  8. Northwesterly along Russell Road (a County road) and Northwesterly along Espinosa Road (a County road) to the intersection of Highway 183 (a State highway); thence

  9. Westerly to the Pacific Ocean (Monterey Bay) through this line runs through the intersection of Nashua Road (a County road), Molera Road (a County road) and Highway 1 (a State highway); thence

  10. Northerly along the Pacific Ocean (Monterey Bay) to the point of beginning.

B. This Section shall not supersede any other section of this Chapter in which a stricter standard of firearm control is imposed on any area encompassed in Subsection A.

11.88.016 - Toro Park minimum standards.

No person shall shoot or discharge a firearm within one-quarter mile of a dwelling, school, or place of public assembly within the boundaries of the unincorporated area situate in the County of Monterey, State of California, particularly described as follows:

The area of the County bounded by Highway 68 on the East, Fort Ord Military Reservation on the South and West, and Reservation Road on the North.

11.88.020 - Discharge of firearm within public dump or disposal site or certain other areas.

Except as provided in Section 11.88.080, no person shall shoot or discharge any firearm within any dump, or garbage or refuse disposal site, maintained by or under the authority of any governmental agency, or within any of those portions of the unincorporated territory of the County of Monterey described as follows:

A. A portion of Monterey City Lands Tract No. 1 and Rancho Las Salinas, Monterey County, California, contained in what is known as the Marina District, and more particularly described as follows:

Beginning at an iron monument standing in the northwesterly corner of "Locke-Paddon Company's Bayside Subdivision of Monterey City Lands," as per map thereof filed February 8, 1916, in Volume 2 of Maps and Grants Outside Lands at page 15, Records of Monterey County, California, and running thence along the northerly boundary of said Bayside Subdivision.

  1. N 65° 48 W, 1,558.30 feet, thence

  2. N 65° 30 W, 5,286.36 feet to the northeast corner of "Locke-Paddon Third Subdivision of Monterey City Lands," as per map thereof filed September 14, 1915, in Volume 2 of Maps and Grants Outside Lands at page 12, Records of Monterey County, California; thence following along southeasterly line of said Third Subdivision,

  3. S 39° 52 W, 2,972.60 feet to a point in the northwesterly right-of-way line of the DeForest County Road; thence along the northwesterly line of said road and its northeasterly prolongation,

  4. S 82° 20 E, 2,164.14 feet to the most northerly corner of that certain 37.39-acre tract of land conveyed by Mary C. Freitas to Martin Girotti by deed dated April 15, 1941, recorded in Volume 716 of Official Records at page 300, Records of Monterey County, California, thence

  5. S 26° 36 E, 1,866.48 feet to the most easterly corner thereof, thence

  6. S 66° 12 W, 2,135.10 feet to the southeast corner of that certain 18.75-acre tract of land conveyed by E. B. and Carolina G. DeForest to W. F. H. and E. G. Schulte by deed dated January 18, 1946, recorded in Volume 903 of Official Records at page 125, Records of Monterey County, California, thence

  7. N 60° 15 W, along the south line of said 18.75-acre tract of land to the northeast corner of that certain tract of land conveyed by George Alfred Maddock to William and Zelphia Matlow by deed dated February 1, 1946, recorded in Volume 913 of Official Records at page 401, Records of Monterey County, California, thence

  8. S 31° 04 W, along the easterly line of said Matlow tract to a point in the northeasterly right-of-way line of the Reservation County Road, thence

  9. S 59° 36 E, along the northeasterly right-of-way line of said Reservation County Road to a point where the same is intersected by the northeasterly prolongation of the easterly boundary of "Locke-Paddon Subdivision of Monterey City Lands," as per map thereof filed June 7, 1915, recorded in Volume 2 of Maps and Grants at page 10, Records of Monterey County, California, thence

  10. S 30° 24 W, along the easterly line of said Locke-Paddon Subdivision and its northeasterly prolongation to the southeast corner of "Locke-Paddon Second Subdivision of Monterey City Lands," as per map thereof filed August 19, 1915, recorded in Volume 2 of Maps and Grants at page 11, Records of Monterey County, California, thence

  11. N 59° 36 W, along the southerly boundary of said "Locke-Paddon Second Subdivision" and "Locke-Paddon Bayside Subdivision" to a point on the shoreline of Monterey Bay; thence northeasterly along the shoreline of Monterey Bay to the place of beginning;

B. Beginning at a point in the centerline of the Salinas-Monterey Road (a state highway), from which point the intersection of said Salinas-Monterey Road and the centerline of Laureles Grade bears in a general easterly direction one thousand five hundred (1,500) feet distance and running thence from said place of beginning in a general southeasterly direction one thousand five hundred (1,500) feet westerly of and parallel to the centerline of Laureles Grade to a point that is one thousand five hundred (1,500) feet southwesterly of the intersection of the centerline of Laureles Grade and the centerline of Robley Road; thence one thousand five hundred (1,500) feet southwesterly of and parallel to the centerline of Robley Road to the line between sections 10 and 15, Township 16 South, Range 4 East, Mount Diablo Meridian, thence east along the section lines to the southeast corner of section 7, Township 16 South, Range 3 East, Mount Diablo Meridian; thence northerly to the northeast corner of section 7, Township 16 South, Range 3 East, thence in a general northwesterly direction to a point that is one thousand five hundred (1,500) feet northeasterly of the intersection of Harper Canyon Road and San Benancio Canyon; thence in a general northwesterly direction one thousand five hundred (1,500) feet northeasterly of and parallel to the centerline of San Benancio Canyon Road an northwesterly prolongation to a point that is one thousand five hundred (1,500) feet northwesterly of the centerline of the Salinas-Monterey Road (a state highway); thence in a general southwesterly direction one thousand five hundred (1,500) feet northwesterly of and parallel to the Salinas-Monterey Road to a point that is one thousand five hundred (1,500) feet southwesterly of the northerly prolongation of Laureles Grade; thence in a general southeasterly direction to the place of beginning;

C. Beginning at a point on the shoreline of Monterey Bay; said point being six hundred (600) feet southerly, measured at right angles from the southerly line of Potrero Road (a County road), and running in a general easterly direction parallel to and six hundred (600) feet southerly from the southerly line of Potrero Road and its northeasterly prolongation to a point that is six hundred (600) feet easterly of and measured at right angles from the easterly line of the California State Highway; thence in a general northerly direction parallel to and six hundred (600) feet easterly from the easterly line of said State Highway to a point in the southerly line of U.S. Lot 10, Section 7, Township 13 South, Range 2 East, Mount Diablo Meridian; thence due west to the shoreline of Monterey Bay; thence in a general southwesterly direction along the shoreline to the place of beginning; also, all that portion of the Elkhorn Slough lying west of the west boundary of Section 8, Township 13 South, Range 2 East, Mount Diablo Meridian;

D. Beginning at the intersection of the centerline of the Tassajara Road and the southwest boundary of Los Tularcitos Rancho; thence in a southeasterly direction along the southwesterly boundary of said Los Tularcitos Rancho to its intersection with the westerly line of U. S. Lot No. 1 in Section 6, Township 18 South, Range 4 East, Mount Diablo Meridian; thence south and east along the west and south boundaries of said U. S. E. Situated in Rancho Los Vergeles, Monterey County, California, and being a strip of land two hundred (200) yards wide lying one hundred (100) yards on each side of the following described line:

Beginning at the intersection of San Juan Grade Road and Crazy Horse Canyon Road and running thence in a northeasterly direction along the centerline of said San Juan Grade Road to the intersection of the Monterey County and San Benito County Line;

F. Situated in Rancho Los Vergeles and Bolsa Nueva y Moro Cojo and Bolsa de Las Escarpines in Monterey County, California, and being a strip of land two hundred (200) yards wide lying one hundred (100) yards on each side of the following described line:

Beginning at the intersection of Crazy Horse Canyon Road and State Highway Route 2 (U.S. 101) and running thence in a southeasterly direction along Crazy Horse Canyon Road to its intersection with San Juan Grade Road; excepting from the above description all that real property which is owned or is presently occupied by Unedynamics, a division of Universal Match Corporation;

G. Situated in Ranchos Los Vergeles and Natividad, Monterey County, California, and being a strip of land 200 yards wide lying one hundred (100) yards each side of the following described line:

Beginning at the intersection of Crazy Horse Road and Old Stage Road and running thence in a northeasterly direction along Old Stage Road to its intersection with the Monterey County and San Benito County line;

H. Beginning at the intersection of Highway 1 and Palo Colorado Road extending five hundred (500) feet on each side Palo Colorado Road following Palo Colorado Road (a distance of approximately four miles) to its intersection with the ridge between Rocky Creek and Bixby Creek, said ridge known locally as the Hoist and indicated on USGS Mt. Carmel Quadrangle by Benchmark 1343 from the point of beginning;

I. Beginning at the intersection of Palo Colorado Road and Garrapata Creek Road extending five hundred (500) feet on each side of Garrapata Creek Road following Garrapata Creek Road (a distance of approximately two miles) to its end at approximately the township line between Township 17 South and Township 18 South, Mount Diablo Base and Meridian;

J. Beginning at a point of intersection with the centerline of California State Highway No. 1 and the centerline of Carmel Valley Road and running; thence easterly along the centerline of Carmel Valley Road to a point of intersection with the northerly boundary of the existing Carmel Valley no-shooting district; thence easterly along the northerly boundary of said Carmel Valley no-shooting district to a point of intersection with the centerline of Laureles Grade; thence northerly along the centerline of Laureles Grade to a point of intersection with the centerline of California State Highway No. 68; thence westerly along the centerline of California State Highway No. 68 to a point of intersection with the westerly boundary of Saucito Rancho; thence southerly along the westerly boundary of Saucito Rancho to a point of intersection with the northerly boundary of Jacks Peak Park Addition No. 2, said northerly boundary shown and so designated on that certain map entitled, "Record of Survey of the Northerly Boundary of Jacks Peak Park, Addition No. 2," recorded and filed in Volume of Surveys at Page…, Official Records of Monterey County, California thence following along said northerly boundary the following nine courses:

  11. 163.52 feet along the arc of a tangent curve concave to the southeast of a radius of 167.80 feet (long chord bears S 48° 11 W, 175.12 feet) to a four-foot by four-foot post marked "S 4 L", thence tangentially

  12. S 20° 16 W, 171.80 feet to a four-foot by four-foot post marked "S 5 L", thence

  13. 324.11 feet along the arc of a tangent curve concave to the north of a radius of 180 feet (long chord bears S 71° 51 W, 282.06 feet) to a four-foot by four-foot post marked "S 6 L", thence tangentially

  14. N 56° 34 W, 483.10 feet to a four-foot by four-foot post marked "S 7 L", thence

  15. 115.17 feet along the arc of a tangent curve concave to the south of a radius of seventy (70) feet (long chord bears S 76° 18 W, 102.61 feet) to a four-foot by four-foot post marked "S 8 L", thence tangentially

  16. 243.98 feet along the arc of a curve concave to the northwest of a radius of 243.40 feet (long chord bears S 57° 53 W, 233.90 feet) to a four-foot by four-foot post marked "S 9 L", thence tangentially

  17. S 86° 36 W, 128.30 feet to a four-foot by four-foot post marked "S 10 L", thence

  18. 74.23 feet along the arc of a tangent curve concave to the north of a radius of two hundred thirty (230) feet (long chord bears S 84° 09 15" W, 73.91 feet) to a point on the centerline of a right-of-way sixty (60) feet wide; thence following said centerline of said right-of-way and leaving said southerly line of said County road,

  19. S 46° 38 W, 89.12 feet to a three-foot by three-foot stake marked "Lot D-Lot E"; thence leaving said centerline of said right-of-way,

  20. S 38° 39 20" W, 474.12 feet to a three-foot by three-foot stake marked "A-8", thence

  21. S 25° 28 45" W, 380.69 feet to a three-foot by three-foot stake set in the southerly line of said Lot 14, said three-foot by three-foot stake being on the northerly boundary of Canada de la Segunda Rancho; thence northwesterly along the northerly boundary of said Rancho to a point of intersection with the centerline of California State Highway No. 1; thence southerly along the centerline of California State Highway No. 1 to the point of beginning; excepting therefrom, that portion described as follows:

Beginning at a point of intersection with the centerline of California State Highway No. 68 and the westerly boundary of Saucito Rancho and running; thence due south to a point of intersection with the northerly boundary of Canada de la Segunda Rancho; thence easterly along the northerly boundary of Canada de la Segunda Rancho and the northerly boundary of the James Meadows Tract to the most northeasterly corner thereof; thence northeasterly, in a direct line, to a point of intersection with the most easterly corner of Monterey City Lands, Tract No. 2; thence westerly along the northerly boundary of Monterey City Lands, Tract No. 2, to a point of intersection with the centerline of California State Highway No. 68; thence westerly along the centerline of California State Highway No. 68 to the point of beginning,

K. Situated in Rancho El Toro, Monterey County, California, and being more particularly described as follows:

Beginning at the most easterly corner of that certain 140,988-acre parcel of land as said parcel is shown and so designated on that certain map entitled "Record of Survey of 211.482 Acre Tract of Land in Assessors Lot 3 of Rancho El Toro," filed for record February 28, 1958, in Volume 5 of Surveys at Page 159, Records of Monterey County; thence from said place of beginning and along the northeasterly boundary of said 140.988-acre parcel:

  1. N 57° 23 W, 1,026.48 feet to the most northerly corner of said 140.988-acre parcel; thence along the northwesterly boundary of said 140.988-acre parcel and the northwesterly boundary of that certain 70.494-acre parcel as said 70.494-acre parcel is shown and so designated on the aforesaid filed survey map,

  2. S 49° 24 15" W, 410.48 feet, thence

  15. Northeasterly on the arc of a circular curve to the right through a central angle of 4° 14 with a radius of one thousand five hundred forty (1,540) feet for an arc distance of 113.78 feet; thence leaving said curve and tangent thereto,

  16. N 45° 44 30" E, 2,244.37 feet, thence tangentially curving,

  17. Northeasterly on the arc of a circular curve to the right through a central angle of 6° 17 15" with a radius of 5,040 feet for an arc distance of 553.08 feet; at 480.31 feet intersect the easterly corner of said 70.494-acre parcel and the southerly corner of said 140.988-acre parcel; 553.09 feet; thence leaving said curve and tangent thereto,

  18. N 52° 01 45" E, 661.52 feet; thence tangentially curving,

  19. Northeasterly on the arc of a circular curve to the left through a central angle of 23° 14 45" with a radius of 2,460 feet for an arc distance of 998.06 feet; thence leaving said curve and tangent thereto,

  20. N 28° 47 E, 3,141.90 feet to the place of beginning;

L. Carmel Highlands and Malpaso Creek, Situate in San Jose Y Sur Chiquito Rancho and Township 16 South, Range 1 West, Mount Diablo Base, County of Monterey, State of California, and being more particularly described as follows:

Beginning at a point of intersection with shoreline of the Pacific Ocean and the center of Malpaso Creek and running thence in a general easterly direction along the center of Malpaso Creek to a point of intersection with the easterly boundary of San Jose Y Sur Chiquito Rancho; thence northwesterly along the easterly boundary of said Rancho to a point of intersection with the range line between Range 1 West and Range 1 East; thence northerly along said range line to a point of intersection with the southerly boundary of that certain 610+-acre tract of land as described in Parcel 9 in that certain "Estate of Sidney W. Fish, deceased," filed for record on July 6, 1953, and recorded in Book 1485 of Official Records at page 485, Records of Monterey County, California; thence in a general westerly, northerly, and easterly direction along the southerly, westerly, and northerly boundary of said six hundred ten (610) acre tract to a point of intersection with the range line between Range 1 West and Range 1 East; thence northerly along said range line to a point of intersection with the center of Carmel River; thence westerly along the center of Carmel River to a point of intersection with the shoreline of the Pacific Ocean; thence southerly along the shoreline of the Pacific Ocean to a point of intersection with the center of San Jose Creek; thence in a general southeasterly direction along the center of San Jose Creek to a point of intersection with the easterly boundary of San Jose Y Sur Chiquito Rancho; thence southerly along the easterly boundary of said rancho to a point of intersection with the center of Gibson Creek; thence westerly along the center of Gibson Creek to a point of intersection with the shoreline of the Pacific Ocean; thence southerly along the shoreline of the Pacific Ocean to the point of beginning.

11.88.022 - Discharge of firearms in the vicinity of Tassajara Road.

A. Except as provided in Subsection B, no person shall shoot or discharge any firearm from any point within one-half mile of the centerline of Tassajara Road and the end of the County-maintained portion of Tassajara Road at Tassajara Hot Springs, or from any point within one-half mile radius drawn at either end of said Tassajara Road centerline.

B. This Section shall not apply in any of the circumstances described in Section 11.88.080 and shall not apply to the discharge of firearms in connection with hunting activities, where the person discharging the firearm is the holder of a valid California hunting license and his or her hunting activities and discharge of such firearm are in conformity with such license and all applicable hunting regulations of the State of California.

11.88.030 - Discharge of firearm—Airgun or other device releasing a projectile in certain areas.

Except as provided in Section 11.88.080, no person shall shoot or discharge any firearm, or use any air or gas gun, sling, elastic, or spring gun, slingshot, bow, crossbow, dart, or any implement or mechanical appliance by which any bullet, shot, stone, dart or other projectile may be propelled, sprung, or thrown from one place to another, within that portion of the unincorporated territory of the County of Monterey described as follows:

A. All of the territory within the Carmel Valley Fire Protection District, formerly called Tularcitos Fire Protection District, Monterey County, California, said territory being described as follows:

C. To aid in giving notice of the prohibitions of this ordinance, the Monterey County Director of Public Works is directed to place and maintain appropriate signs at the point or points where County roads cross, commence within or abut the boundaries, of the territory hereinabove described.

11.88.080 - Exemptions.

This Chapter shall not apply to:

A. Any person who acts pursuant to any of those situations specified in Sections 195, 196, and 197 of the California Penal Code as making homicide excusable or justifiable;

B. Any peace officer while performing his or her official duties;

C. Uses for which a use permit is obtained under Section 11.88.085;

D. The lawful occupant of privately owned land zoned and used for agricultural purposes, or the employees or agents of such occupant, while lawfully engaged in destroying predatory or destructive birds or mammals upon such land. As used in this Section, "zoned for agricultural purposes" shall mean land within the following zoning categories: agricultural preservation, agricultural conservation, farmlands, rural grazing, permanent grazing and resource conservation;

E. An owner of livestock who slaughters the livestock for personal use.

11.88.085 - Use permits.

It shall be unlawful for any person to establish, maintain or operate a shooting gallery, target range, or trap or skeet shooting range unless he or she first obtains a use permit to establish such use as provided for in Title 20 of this Code. Presently established shooting galleries, target ranges, or trap or skeet shooting ranges shall become legal nonconforming uses to the extent that they comply with the Firearms Ordinance except that trap and skeet shooting are not permitted on Sundays and those holidays specified in Section 6700 of the California Government Code.

11.88.090 - Posting of signs.

To aid in giving notice of the prohibitions of this Chapter, the Monterey County road commissioner is directed to place and maintain appropriate signs at bridges and railroad crossings on County roads within or abutting the no-shooting areas described in this Chapter, and at the point or points where County roads cross, commence within, or abut the boundaries of such no-shooting area.
