§ 13.05.010. Purpose.¶
The purpose of this chapter is to designate the Director of Public Works as having the authority to accept roads into the County Road System and to accept conveyances for roadway purposes. In addition, this chapter delineates the procedures that the Director of Public Works shall follow in accepting roads into the County Road System and for recording roadway conveyances.

§ 13.05.020. Definitions.¶
County road system:
The County Road System is the network of County roads that has been officially established and is recognized by the State of California as being maintained by the County of Merced. Neither general County funds nor gas tax funds may be expended for the purpose of maintaining public roads other than County roads.
Roadway conveyances:
A Roadway Conveyance is a legal document transferring title interest in real property for public road purposes.

§ 13.05.030. Designated Officer of the Board.¶
Pursuant to § 941(d) of the California Streets and Highways Code, the Director of Public Works is designated as an officer authorized to accept, on behalf of the Board, roads or portions thereof, into the County Road System and to record conveyances to the County of real property interests for road uses and purposes.

§ 13.05.040. Procedures for Acceptance.¶
A. Accepting Roads into the County Road System:
The Department of Public Works shall prepare an acceptance certificate for each new road, or portion thereof, to be accepted into the County Road System. The acceptance certificate shall contain, at a minimum, the following information: the legal description of the road, the name of the road, the length of the road, the County assigned road number, the date of acceptance, and a signature block for the Director of Public Works.
The acceptance certificate shall be signed by the Director of Public Works, in duplicate. One original certificate shall be filed at the Department of Public Works and the other original certificate shall be submitted to CALTRANS when the official maintained mileage maps and tabulations are to be updated.
B. Accepting Roadway Conveyances of Real Property Interests:
The Department of Public Works shall prepare an acceptance certificate for each roadway conveyance to be accepted by the County. The certificate shall at a minimum accept the document transferring title and shall accept the real property into the County Road System. Certificate shall contain the name and number of the County Road.
The instrument of conveyance shall be checked by the Department of Public Works for accuracy of the legal description of the property to be conveyed.
The Director of Public Works shall, prior to recording any conveyance, affix the acceptance certificate, as described in 13.05.040.B.1, to the instrument.
The instrument of conveyance and the acceptance certificate shall be delivered by the Department of Public Works or approved escrow company to the Office of the County Recorder for recordation.
The original instrument of conveyance and the acceptance certificate shall be filed at the County Surveyor's Office.

§ 13.05.050. Reporting to the Board.¶
The Director of Public Works shall report all acceptances and recordings to the Board at the end of each fiscal year.
