9.116.010 Definitions .¶
As used in this chapter, a "garage sale" means the sale or offering for sale of used goods or other personal property held at a private residence by the occupants and is limited to the sale of common household goods such as clothing, interior furnishings, small appliances, toys and other similar items where such goods are personal property and are set out for the public display in any open garage, yard or patio of such private residence. "Garage sale" also means and includes estate sales arising from the death of an occupant of the property.

9.116.020 Permit required .¶
No person shall conduct, cause, or permit to be conducted a garage sale without first obtaining a garage sale permit. The fee for such permit shall be in such amount as is set by resolution of the city council and which shall compensate the city for the actual costs of the permit processing and enforcement and the costs of administering this chapter.

9.116.030 Term of permit .¶
(a) A permit issued under the provisions of this section will be valid for a period consisting of two consecutive days. No person will be granted a permit to conduct more than two garage sales during any calendar year.
(b) Any person who has not conducted two garage sales during the preceding calendar year and who moves to a new residence where two garage sales have been conducted may be issued a permit for a garage sale to be held at the new residence location under the provisions of subsection (a) of this section.
(c) Any person who is acting in a representative capacity of a deceased person may be issued a permit to conduct a garage sale at the residence of the deceased. Issuance of such permit shall not limit the right of such person to obtain a garage sale permit in his or her individual capacity.

9.116.040 Permit--Nontransferable .¶
A permit issued under the provisions of this chapter shall be nontransferable.

9.116.050 Display of Permit .¶
The permit required under this chapter shall be conspicuously displayed on the premises where the garage sale is conducted during the hours of the garage sale.

9.116.060 Manner of sale .¶
Garage sales shall be conducted in accordance with the following conditions:
(a) Garage sales may only be conducted on Saturdays and Sundays;
(b) Each garage sale may be held from eight a.m. to six p.m.;
(c) The merchandise offered for sale is limited to the resident's personal goods. The sale of merchandise acquired for the purpose of resale is prohibited;
(d) One sign with an area not greater than six square feet may be posted on the private property where the sale is held;
(e) Directional signs with an area not greater than six square feet may be posted on private property other than the property on which the sale will be held with the property owner's permission and shall be removed promptly at the conclusion of the garage sale;
(f) No signs advertising the garage sale may be erected, or posted on, or attached to, public property.
