Sec. 1-8-101. - General prohibition.¶
The City and all City-affiliated agencies shall not exercise the power of eminent domain to acquire property from any private Owner thereof, without such Owner's consent, when the purpose of the acquisition is to convey the property so acquired to any private party.

Sec. 1-8-102. - Definitions.¶
A. As used in this division, "City-affiliated agencies" means all entities possessing the power of eminent domain the governing board of which is solely composed of, or is solely appointed by, the members of the Irvine City Council.
B. As used in this division, "Owner" means the owner of the fee title interest in the property to be acquired.

Sec. 1-8-103. - Interpretation.¶
This division is not intended and shall not be construed to prohibit the exercise of the power of eminent domain to acquire property from any private Owner thereof, with or without such Owner's consent, when the purpose of the acquisition is for traditional governmental projects and improvements, including, but not limited to, municipal buildings, streets, parks and open space, sewers, storm drains, and flood control, and when the property so acquired is not to be conveyed to any private party.
