(a) Pursuant to the provisions of the California Health and Safety Code Sections 25500 through 25521, or as they may be amended, the Fire Department of Los Angeles County is designated as the administering agency for the implementation of the hazardous material inventory and emergency response program within the City of Inglewood.

(b) In order to effect such implementation the Fire Chief shall:

(1) Enforce the provisions of the California Hazardous Materials Release Response Plans and Inventory Law; and

(2) Prepare supplemental regulations from time to time to facilitate such enforcement.

§ 6-5.1. Penalties.

(a) Pursuant to the authority found in Health and Safety Code Section 25514, as may be amended, every person or business violating Health and Safety Code Sections 25503.5 to 25505 or Sections 25508 to 25510 shall be civilly liable in amounts not to exceed fines set by Health and Safety Code Sections 25514(a) and (b).

(b) Pursuant to the authority and subject to the criminal penalties established in Health and Safety Code Section 25515, as may be amended from time to time, every person or business violating Health and Safety Code Sections 25507 shall be criminally liable. Every person or business violating Health and Safety Code Section 25507 after a first conviction may be prosecuted as a misdemeanant or a felon.

§ 6-5.2. Plan Check and Inspection Fees.

(a) For purposes of this Section "hazardous materials" has the meaning assigned to that term and related terms by the Health and Safety Code.

(b) Any business required to establish and implement a business plan pursuant to Section 25503.5 or which is required to file an acutely hazardous materials registration form pursuant to Section 25533 of the Health and Safety Code shall pay an annual plan check and inspection fee in accordance with the following schedule:

IIIA Greater than 10,000 cu. ft. Low/or underground storage $150.00
IB (As in Class IA) Moderate $150.00
IIB (As in Class IIA) Moderate $200.00

When a fee may be determined by more than one method, the highest fee shall prevail.
