13.54.010 - Purpose.

The town has adopted a Stormwater Management and Discharge Control ordinance (Chapter 13.50 of the Hillsborough Municipal Code) implementing the National Pollutant Discharge Elimination System (NPDES) Stormwater Pollution Prevention Program in Hillsborough as mandated by federal law. The city council has determined that an annual storm drainage charge applicable to each parcel in the town is necessary to meet the town's costs associated with this program. The purpose of this chapter is to set forth such storm drainage charge and related provisions.

California Health and Safety Code Section 5471 authorizes the town to set storm drainage charges by ordinance.

13.54.030 - Service charge.

The annual storm drainage charge effective for fiscal year 1994-95 (and for each subsequent fiscal year) shall be $7.34 per parcel per year.

13.54.040 - Collection of charges.

The storm drainage charges specified in this chapter shall be collected on the tax roll in the same manner, by the same persons, and at the same time as, together with and not separately from, the general taxes applicable to real property within the town of Hillsborough. A written report shall be prepared each year and filed with the city clerk, which shall contain a description of each parcel of real property receiving storm drainage services and the amount of the storm drainage charge for each parcel for the year, computed in conformity with the charges prescribed in this chapter. The city council shall adopt a resolution each year authorizing the county controller to place the storm drainage charges on the tax roll for the upcoming fiscal year and authorizing the county tax collector to collect such taxes. The procedure to place the charges on the tax rolls and publication of notices and hearings shall be that prescribed in California Health and Safety Code Sections 5473 through 5473.8.

13.54.050 - Disposition.

All storm drainage charges required to be paid by this chapter shall be paid to the county tax collector who shall remit such collections to the town less the applicable collection charge. The town shall use such storm drainage charge collections solely for the purpose allowed by law.
