§ 16.48.010. Designated.¶
In addition to the general provisions of this code providing that violations are misdemeanors, the following specific penalties are applicable to violations of this title: Each such person is guilty of a separate offense for each and every day during any portion of which any violation of this title, including any physical condition created in violation of this title, is permitted, continued or committed by such person. Any lot, street, alley, easement sewer, water line, storm drain or other physical condition maintained contrary to the provisions hereof shall constitute a public nuisance. In addition to the foregoing, any deed of conveyance, sale or contract to sell which is made contrary to the provisions of this title is voidable to the extent and in the same manner provided in Section 11540 of the Business and Professions Code. The city, or any aggrieved person, may file suit in the superior court of the county in which any property is split or divided in violation of this title is located, to restrain or enjoin any attempted or proposed split or sale contrary to the provisions of this title, pursuant to Section 11542 of the Business and Professions Code.
