§ 8.28.010. Definitions.¶
As used in this chapter:
"Adequately vented"
means the condition of a gas heater which is connected to an effective vent leading to the outside air, which vent conforms in type and design to the minimum standards, and has been installed in compliance with the installation and venting requirements set forth in the rules and regulations of the Department of Industrial Relations, Division of Housing, and the standards set out in the 1985 Edition of the Uniform Building Code.
"Gas heater"
means and includes every space or room heater which is designed to use natural, manufactured or mixed gas or a liquefied petroleum gas, or liquefied petroleum gas-air mixture as a fuel medium.
"Persons"
means and includes individuals, partnerships, corporations, firms, associations and any legal entity.
"Place of human habitation"
means and includes any dwelling or dwelling unit, including private residences, hotels, motels, apartments, apartment houses, trailer houses, roominghouses, or any other place where human beings customarily live or sleep.

§ 8.28.020. Permit—Required for installation when.¶
It is unlawful for any person to install any gas heater in any place of human habitation without first obtaining a permit for such installation from the City Building Inspector.

§ 8.28.030. Selling certain gas heaters—Restrictions.¶
It is unlawful for any person to sell, rent or otherwise transfer possession of any gas heater which is so designed or constructed that it cannot readily be adequately vented, without first informing the transferee in writing that the subject matter of the transfer cannot be legally installed in a place of human habitation in the City.

§ 8.28.040. Unvented gas heaters—Installation prohibited where.¶
It is unlawful for any person to install or permit to be installed in any place of human habitation any gas heater which is not adequately vented.

§ 8.28.050. Unvented gas heaters—Notice to County Building Department required when.¶
Every person having sold, rented or otherwise transferred possession of any gas heater which is so designed or constructed that it cannot be readily or adequately vented shall submit notice of such sale, rental or transfer within 48 hours thereof to the County Department of Building and Safety, in the form of a duplicate bill of sale, which bill of sale be identical with the original, and shall contain the following information:
A. Name and address of the person, store or business selling, renting or transferring the gas heater;
B. Date of sale;
C. Make, serial number and type of heater sold;
D. Name and address of person buying, renting or obtaining the gas heater;
E. A statement signed by the transferee which states:
| I have entered into this transaction with the understanding that the gas heater which is the subject matter of this transaction cannot be legally installed in a place of human habitation within the City of Guadalupe. |

§ 8.28.060. Violation—Penalty.¶
Every person who violates any of the provisions of this chapter is guilty of a misdemeanor, and upon conviction thereof shall be punished by imprisonment in the County jail for not to exceed 6 months, or by a fine not to exceed $500.00, or by both such fine and imprisonment.
