§ 3.32.010. Title for citation.

The ordinance codified in this chapter shall be known as the "Guadalupe Facility Development, and User Fee Ordinance."

§ 3.32.020. Purpose of fees and charges.

The City Council hereby declares that fees and charges being collected for the use of City facilities and for the provision of special City services have not been keeping pace with increases in the Consumer Price Index, and with corresponding increases in the cost of providing those services. The purpose of this chapter is to bring fees and charges up to date and to establish a procedure for adjusting them annually by resolution in accordance with changes in the Consumer Price Index.

§ 3.32.030. Fees set by Council resolution—Annual adjustments.

A. All fees charged by the City for the use of City facilities, delivery of City services, business licenses, and other regulatory or revenue-producing activities not otherwise preempted by County, State or federal jurisdictions, shall henceforth be established and adjusted by City Council resolution.

B. Such user fees and charges shall be adjusted annually for changes in the cost of living ("COL"). Such COL change adjustment shall not exceed the prior annual COL change as determined by the Consumer Price Index ("CPI") for the United States, as reported by the United States Department of Labor; provided, however, the fee changed per COL from the preceding year shall in no event exceed the change in California per-capita income from such preceding year.

C. Annual adjustment shall be accomplished by administrative action of the City Administrator on June 1st of each year. Provided however, that the City Council may overrule or modify such administrative adjustment by Council resolution adopted between June 1st and July 1st of each year. Adjustments to bring present rates up to date may be done by City Council resolution prior to June 1, 1985.

§ 3.32.040. Amendment to existing ordinances.

The ordinance codified in this chapter amends the fee-setting section of all existing City ordinances by adding the following clause: "Those sections of existing ordinances which set or establish fees shall become null and void upon adoption of City Council resolution(s) which specifically replace said sections. Each resolution which replaces the fee setting section of any ordinance shall make specific reference to each section of each ordinance being replaced."
