Fresno County Municipal Code Ch. 8.08 Planting Diseased Vegetables

The following words and phrases when used in any provisions of this chapter shall be construed to have the following meanings:

A. "Agricultural commissioner" means the agricultural commissioner of Fresno County;

B. "Lettuce mosaic virus" means a seedborne virus disease which infects lettuce;

C. "Mosaic free seed" means seeds where there is no seedborne mosaic virus infected seedlings in thirty thousand seedlings tested and marketed in a container which is so labeled.

It is unlawful for any person to plant any lettuce seed in the unincorporated area of the county which has not been determined to mosaic free seed.

Notwithstanding the provision of Section 8.08.020, any person desiring to plant lettuce seed other than that which has been found to be mosaic free may apply to the agricultural commissioner for a permit to plant such seed. The application shall be in writing and shall be in such form and detail as the agricultural commissioner may require. If the agricultural commissioner finds that mosaic free lettuce seed of any variety is not then obtainable, he shall issue a permit authorizing the applicant to plant some other lettuce seed which is obtainable and which the commissioner finds involves the least danger to lettuce crops in the county.

It is unlawful for any person hereinafter named to not immediately disc or otherwise destroy lettuce found by the agricultural commissioner to be in a field which has been abandoned or on which the harvest of lettuce for consumption or seed has been completed after the agricultural commissioner has given written notice to the owner, tenant or occupant of the field to cause the field to be disced or otherwise destroyed in a manner satisfactory to the agricultural commissioner.

This chapter shall not prohibit any person from planting lettuce seed which has not been indexed as mosaic free seed for such person's own home use.
