15.70.010 - Purpose and applicability.

Recognizing availability of affordable temporary housing when a single-family residence is made inhabitable or destroyed by fire, vehicle accident, or other natural cause, Temporary Housing as described herein may be allowed in accordance with the provisions of this chapter are applicable only to the resident who is identified as the property owner of record.

The provisions of this chapter shall be in effect only for a period of one-year from date of verification of structure loss or damage as detailed by report from local Fire Protection Agency or Special Inspection Damage Investigation report provided by County of Fresno Department of Public Works and Planning, Development Services Division.

15.70.020 - Debris removal and demolition.

A. The provisions of section 15.04.110 of this Title shall apply.

B. Debris removal where hazardous materials exist shall be in accordance with local and state agency(s) requirements. Documentation of lawful remediation required.

15.70.030 - Temporary housing.

A. Temporary housing, also referred to as Temporary Housing Units, may be provided by means of:

  1. Recreational Vehicle (RV) defined as a motor home or travel that includes installed elements, appliances, and fixtures for sleeping, cooking, bathing, and toilet facilities in proper working order. Exterior envelope must resist intrusion of weather.

a. RVs utilized must be operable with current licensing through California Department of Motor Vehicles.

b. RVs must be certified meeting NFPA 1192, ANSI A119.5, ANSI RVIA Standard for Low Voltage Systems, and provisions of NEC Art. 551; or

  1. Tiny Houses complying with the provisions of Appendix Q of the California Residential Code.

B. Location of Temporary Housing units shall be located outside of boundaries of recorded easements and comply with setbacks identified in property zone district and/or the provisions of section 15.60.300 of this Title for parcels located in the State Responsibility Area (SRA).

C. Temporary Housing Units shall be provided with, a listed smoke detector and carbon dioxide detector in each segregated living area.

D. Temporary housing served by propane fuel shall be equipped with a listed propane gas detector.

E. The provisions of Appendix AZ of the California Residential Code may be utilized.

15.70.040 - Water and sewer facilities.

A. Temporary Housing Units shall be connected by means of a listed flexible connector to a potable water source in accordance with the California Plumbing Code.

B. Temporary Housing Units shall be connected to a public sewer or an approved onsite wastewater treatment system.

15.70.050 - Electrical.

A. The provisions of section 15.60 of this ordinance and the adopted California Electrical code shall apply.

15.70.060 - Permits required.

A. Permits are required for the installation of Temporary Housing Units.

  1. Permit applications shall include as detailed site plan in accordance with CBC 107.2.6, foundation support system including lateral movement resistance detailed elements, and manufacture's information for proposed units utilizing Tiny Homes.

  2. RV's to be installed per manufacture's recommendations.

15.70.070 - Reconstruction.

A. Reconstruction shall comply with the provisions of all applicable ordinances and adopted codes.

15.70.080 - Deferrals and exemptions.

A. Provisions of the California Energy Code mandating installation of photovoltaic (solar) installation in new construction shall be waived where:

  1. A signed written request is made by the property owner to waive the mandated solar requirements including a testament of lack of insurance coverage allowing for the cost of installation.
