§ 9.04.010. Public intoxication – Misdemeanor.

It is unlawful and a misdemeanor for any person to be found on or in any public street, sidewalk, highway, place or square, or in any place open to public view, in a state of intoxication.

It is unlawful and a misdemeanor for any person not being a lawful resident of such house or premises to be found in any private house or private premises in a state of intoxication, to the annoyance of any other person.

§ 9.04.030. Intoxication in automobile upon public highway – Misdemeanor.

It is unlawful and a misdemeanor for any person to be in or upon any automobile upon any public highway or in any public place, in a state of intoxication.

§ 9.04.040. Violation – Penalty.

Any person who shall violate any provisions of this chapter shall be guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed the sum of $300.00 or by imprisonment in the city or county jail for not more than 90 days, or by both such fine and imprisonment.
