§ 12.12.010. Purpose.

The City Council finds and declares that the purpose of the ordinance codified in this chapter is to regulate the safe use of electric scooters in order to promote the public peace, health, welfare and safety. This chapter is not intended to apply or otherwise restrict "motorized quadricycle," "motorized tricycle," and "electric wheelchairs," as defined in Cal. Veh. Code § 407 and/or the Americans with Disabilities Act (ADA), utilized by persons who by reason of physical disability are otherwise unable to move about as a pedestrian.

§ 12.12.020. Electric scooter defined.

For the purposes of this chapter, "electric scooter" has the same definition as set forth in Cal. Veh. § 407.5 as "motorized scooter," a two (2) wheeled device with handlebars and a floorboard designed to be stood upon when riding and powered by an electric motor.

§ 12.12.030. Regulations for electric scooter operation.

A. All operators under eighteen (18) years of age must wear a properly fitted and fastened bicycle helmet meeting standards described in Cal. Veh. Code § 21212.

B. No person shall operate an electric scooter upon a sidewalk within the downtown business district, or upon any sidewalk within five hundred (500) feet of schools, or upon any other sidewalk designated by posted signage, except when crossing a sidewalk at a driveway or crosswalk or when parking.

C. Electric scooters shall not be operated at speeds exceeding fifteen (15) miles per hour in accordance with Cal. Veh. Code § 22411.

D. The operator of an electric scooter may not do any of the following:

  1. Carry passengers;

  2. Operate without at least one (1) hand on the handlebars;

  3. Operate on roadways with speed limits exceeding twenty-five (25) miles per hour, unless within a Class II or Class IV bikeway, as specified in Cal. Veh. Code § 21235;

  4. Park an electric scooter upon any street, sidewalk, alley, or any other public way other than immediately adjacent to the curb or edge of the traveled way or in a rack to support the electric scooter or against a building, in such a manner as to afford the least obstruction to both pedestrian and vehicle traffic.

§ 12.12.040. Penalties.

A. Violations of the provisions in this chapter shall be subject to fines as follows:

  1. First offense: fifty dollars ($50.00);

  2. Second offense: one hundred dollars ($100.00);

  3. Third and subsequent offenses: two hundred dollars ($200.00).

B. Each instance a violation continues shall constitute a separate offense.

§ 12.12.050. Impoundment of electric scooters.

A. An electric scooter may be impounded if:

  1. The operator has two (2) or more violations of DMC § 12.12.030 within the past twelve (12) months; or

  2. The electric scooter is operated in a manner that endangers public safety.

B. Impounded electric scooters shall be held for a minimum of fourteen (14) days. Release requires payment of all fines and impound fees.
